SECTION 3<br />

USE DISTRICTS<br />

3.4.2 Special Permits<br />

The Commission may grant special permits for the following uses, subject to<br />

the applicable criteria of Section 8.2:<br />

3.4.2.1 Residential uses subject to Section 8.13;<br />

3.4.2.2 Restaurants subject to Section 8.16;<br />

3.4.2.3 Health care facilities including hospitals, convalescent homes and nursing<br />

homes on a lot of five (5) acres or more;<br />

3.4.2.4 Personal services not listed in Section 3.4.1.3.<br />

3.4.2.5 Commercial educational or recreational services;<br />

3.4.2.6 Gasoline filling stations, with or without Connecticut Motor Vehicle Department<br />

Repairers' Licenses, or motor vehicle repair facilities, excluding body shops;<br />

3.4.2.7 Churches, religious buildings and other non-profit organizations<br />

3.4.2.8 Accessory uses customarily incidental to the above Special Permit uses<br />

subject to Section 8.1.<br />

3.4.2.9 Rear lots in commercial zones, subject to Section 8.23<br />

3.4.3 Required Lot Areas, Yards, Coverage, Heights and Frontages.<br />

For required lot areas, yards, coverage, heights and frontages, refer to Section<br />

5.<br />

3.4.4 Special Neighborhood Shopping Regulations<br />

3.4.4.1 Retail establishments and restaurants shall be closed to the public between<br />

the hours of 2:00 a.m. and 5:00 a.m., except that the Commission may require<br />

reduced hours of operation where the development may affect a residential<br />

area.<br />

3.4.4.2 No goods or merchandise shall be stored or displayed outside of a building<br />

except in conformance with an approved site plan or special permit.<br />

3.4.4.3 All uses and accessory uses shall be conducted wholly within enclosed<br />

buildings, except for off street loading and those operations normally<br />

conducted outdoors, and excepting special periodic events; i.e., sidewalk<br />

sales, etc., and other uses specifically authorized by the Commission as part<br />

of the approval of a site plan or the granting of a special permit.<br />
