9.3.13 Excavation Limit<br />

9.4.1 Base Map<br />

An adequate buffer, normally a minimum of fifty (50) feet in width between<br />

abutting property not in mining use and the limit of excavation and a minimum<br />

of eighty (80) feet in width from an existing street or highway and the limit of<br />

excavation, shall be provided. Excavation limits as permitted by the<br />

Commission shall be delineated on the site so that they are clearly visible. If<br />

an applicant wishes to excavate below finished elevations shown on the final<br />

approved plan, the applicant shall demonstrate that sufficient quantities of fill<br />

materials will be available to bring the elevations up to the final elevations<br />

required and shall provide for an increased bond sufficient to cover any cost of<br />

the fill materials.<br />

Sound intensity level shall not exceed the levels recommended by the State of<br />

Connecticut for noise control. At a future date if the Town adopts its own<br />

standards for noise control and they are more stringent than the State Levels,<br />

the applicant's operation shall comply with the Town Regulations.<br />

Applications for permits to operate gravel and sand mining shall be submitted<br />

for approval to the Commission in accordance with Section 8.2 and Section 4<br />

of the Regulations. In addition to the site development requirements of<br />

Section 4, the application shall be supplemented by the following additional<br />

supporting documentation:<br />

The owner of the land, or authorized agent, shall submit a map prepared by an<br />

engineer or a land surveyor licensed by the State of Connecticut which shall:<br />

9.4.1.1 Show the entire parcel of land owned by the applicant, with the area in<br />

question delineated;<br />

9.4.1.2 Be drawn to 1 inch = 40 feet scale or 1 inch = 100 feet scale, based on the<br />

scope or size of a project;<br />

9.4.1.3 Indicate existing contour lines of the project area, as well as all areas within<br />

500 feet thereof, based on existing United States Geodetic Survey (U.S.G.S.).<br />

Said map shall also indicate the location of rock, if known, and ground water<br />

table within the planned mining area;<br />
