SPECIAL <strong>REGULATIONS</strong><br />

h) The extent to which uses proposed for the Active Recreation Area are preleased<br />

or committed for or the extent to which construction and<br />

maintenance of such uses are assured by bonding or other means;<br />

i) The compatibility of the proposed development with other existing sues in<br />

the area and with uses permitted under these Regulations and the<br />

Commission's Subdivision Regulations.<br />

j) The extent and nature of public access, if any, to the proposed Passive<br />

Open Space and Active Recreation Area;<br />

k) How areas within the Passive Open Space and Active Recreation Area are<br />

to be maintained;<br />

l) The phasing of the proposed improvements within the development; and<br />

m) The extent to which proposed water usage will impact existing streams,<br />

watercourses, water bodies and aquifers.<br />

8.19.5 The Commission may require the applicant to adopt for the proposed<br />

development restrictions acceptable to the Commission prohibiting or<br />

regulating snowmobiles, dirt bikes, un-mufflered motor vehicles and other<br />

noise generating machines or activities.<br />

8.19.6 An application for a Special Permit for a Residential/Recreational Development<br />

shall be accompanied by an application for subdivision approval and both<br />

applications; shall be considered by the Commission at the same public<br />

hearing.<br />

8.19.7 Environmental Control of Operations<br />

8.19.7.1 If the activities proposed by the applicant, or reasonably to be expected to<br />

occur on the site, involve the application of any pesticides, herbicides,<br />

fungicides, fertilizers or chemicals, the applicant shall submit as part of its<br />

application a report prepared by a qualified scientist (including, but not<br />

necessarily limited to a geologist, biologist, hydrologist, soil scientist and/or<br />

limnologist). The applicant shall also make the author of the report available<br />

for comment and questioning during the public hearing on the application.<br />

The report shall cover the following matters:<br />

a) The chemical and physical nature of the substances to be applied, the<br />

frequency of application and the quantity involved in each application;<br />

b) The expected effects on water, air and soils (both on-site and off-site,<br />

including aquifers) of the applications (both long and short term) under the<br />

normal operating conditions proposed or expected by the applicant;<br />
