SECTION 8<br />

SPECIAL <strong>REGULATIONS</strong><br />

8.1 ACCESSORY BUILDINGS AND USES<br />

Accessory buildings and uses shall include a garage or carport and the parking<br />

of a commercial vehicle, the parking or storage of a boat, trailer or mobile<br />

home, swimming pool, bath house, storage buildings, sheds and fences and<br />

similar buildings and uses. All accessory buildings and uses are subject to the<br />

following.<br />

8.1.1 No accessory building or structure shall be constructed on any lot prior to the<br />

commencement of construction of the principal building to which it is<br />

accessory.<br />

8.1.2 A building attached to the principal building by a covered passageway, or<br />

having a wall or part of a wall in common, shall be considered part of the<br />

principal structure.<br />

8.1.3 Garages shall be permitted in residential zones as an accessory use to the<br />

primary residential use of the property.<br />

8.1.3.1 The total area of the footprint of all garages shall not exceed 200 square feet<br />

of garage space for every 10,000 square feet of the total land area of the<br />

parcel on which it is to be constructed.<br />

8.1.3.2 Garages shall be set back from all side and rear property lines a minimum<br />

distance equal to one and one-half (1 1/2) times the maximum height of the<br />

garage; a distance equal to the longest linear dimension of the garage; or a<br />

distance in compliance with Section 5 of these Regulations, whichever is<br />

greatest.<br />

8.1.3.3 Any accessory building, including those allowed in this Section 8.1 and any<br />

building permitted in Section 8.15 that is (a) to be built in whole or in part within<br />

one hundred (100) feet from the street line and (b) is to cover a footprint of<br />

more than six hundred (600) square feet will require a Special Permit from the<br />

Commission.<br />

8.1.3.4 Any accessory building, including those allowed in this Section 8.1 and any<br />

building permitted in Sections 8.15.9 and 8.15.11 that is to cover a footprint of<br />

more than one-thousand (1000) square feet will require a Special Permit from<br />

the Commission. This Section (8.1.3.4) shall not be applied to any building,<br />

which is to be built on a farm as defined by these Regulations.<br />

8.1.4 A maximum of two (2) commercial vehicles may be parked on a residential lot,<br />

provided each such commercial vehicle shall have a maximum capacity of one<br />

and one- half (1 1/2) tons and shall be owned by the owner or permanent<br />

resident of the property on which it is to be parked. Commercial vehicles shall<br />

be stored in the garage, a barn or the rear yard of the property, provided they<br />

are not placed within ten (10) feet of a property line.<br />
