SECTION 8<br />

SPECIAL <strong>REGULATIONS</strong><br />

8.16.5 The sale of alcoholic beverages for consumption on the premises may be<br />

permitted as an accessory use. The retail sale of liquor shall be subordinate to<br />

the principal use, which must be that of a restaurant providing service of hot<br />

meals. No more than 15 percent of the gross floor area shall be devoted to a<br />

cocktail lounge or bar. This measurement; shall be derived by calculating the<br />

square footage of the area, which encompasses the bar, the associated stools,<br />

and a three-foot aisle beginning at the back of the stools.<br />

No more than 25 percent of the gross floor area shall be devoted, at any time,<br />

to the combined uses of cocktail lounge, bar, dance floor, stage or standing<br />

room for the viewing of entertainment. The applicant shall provide a floor plan<br />

indicating the size and location of any bar or entertainment area as described<br />

above.<br />

8.16.6 Commercial Recreation may be permitted as an accessory use provided the<br />

commercial Recreation is clearly secondary to the primary restaurant use.<br />

Commercial Recreation shall be limited to a maximum of 25% of the gross<br />

floor area of the restaurant.<br />

8.16.7 Traffic generated by restaurant operations shall not adversely affect traffic<br />

flow, circulation or traffic patterns, or the level of service on adjacent or nearby<br />

streets. The Commission may require an applicant to provide data or analysis<br />

from a qualified traffic engineer or other appropriate expert and may condition<br />

the approval of a special permit on roadway, signalization, intersection,<br />

drainage, or other improvements if the Commission deems such requirements<br />

to be necessary.<br />

8.16.8 Restaurants that are expected to produce more than 300 vehicle trip ends per<br />

peak hour of generation are prohibited.<br />

8.16.9 Dumpsters shall not be allowed within any required yard or buffer and shall<br />

typically be enclosed by an opaque gate with six-foot masonry walls on three<br />

sides. Outdoor storage shall only be allowed within the required dumpster<br />

enclosure or similar structure approved by the Commission.<br />

8.16.10 The design and operation of the proposed restaurant shall be compatible with<br />

other area land uses. In preparing the proposal, the applicant shall take into<br />

account the impact the proposal will have on the area where the development<br />

is planned. Due regard shall be given to:<br />

• Area traffic volumes<br />

• On-site parking and traffic patterns<br />

• Site and off-site litter<br />

• Smoke and cooking odors<br />

• Noise<br />

• Lighting<br />
