SPECIAL <strong>REGULATIONS</strong><br />
8.28 RESIDENTIAL LANDSCAPE BUSINESS<br />
8.28.0 Purpose:<br />
It is the purpose of this regulation to permit the filing of a Special Permit<br />
application, within residential zones, for the operation of a Residential<br />
Landscape Business. Such use may only be permitted where the Commission<br />
determines that such use will be compatible within the specific residential area<br />
identified within the application. Residential Landscape Businesses are those<br />
that provide services in locations away from the business operator’s residence,<br />
performing a service for an off site client.<br />
While most of the actual landscape activity occurs off site, the business<br />
owner’s residential property may be approved for equipment storage, parking,<br />
material storage and a building or buildings for storage and plant propagation.<br />
By allowing such use by Special Permit, but not otherwise, the Commission<br />
provides an opportunity for a business owner to operate such use in<br />
conjunction with a residential property, while creating a mechanism for review,<br />
oversight and registration of the use. The following general guidelines place<br />
basic limitations on such use and establish criteria to aid the Commission in its<br />
evaluation of an application for Residential Landscape Business. It is<br />
understood that proposals for a Residential Landscape Business will vary in<br />
scope and that based on the specific location and surrounding uses, individual<br />
properties will be suited for differing levels of operation. It is further<br />
understood that some sites will simply not be suited at all for such use. The<br />
burden shall be on the applicant to demonstrate that the proposed use is<br />
compatible with the specific site and surrounding area and in compliance with<br />
the criteria set forth in Section 8.2.<br />
In accordance with the above purpose, the Commission may issue a Special<br />
Permit for a Residential Landscape Business, subject to the following<br />
requirements.<br />
8.28.1 The property must be the primary residence of the owner of the Residential<br />
Landscape Business.<br />
8.28.2 The scope of the Residential Landscape Business shall be appropriate to the<br />
size of the property and its proximity to neighboring residential uses.<br />
8.28.3 Retail sales from the property are prohibited.<br />
