MODEL MEMORANDUM OF AGREEMENT REGARDING<br />
THE DEPARTMENT OF STATE’S OVERSEAS<br />
PERSONAL SERVICES AGREEMENT AUTHORITY<br />
Note:<br />
1. Only the Department of State and appropriate US agency headquarters may process this MOA. The<br />
MOA may not be processed at post for an agency’s post-specific or regional participation under the <strong>Local</strong><br />
<strong>Employment</strong> <strong>Policy</strong>.<br />
2. HR/OE/PC maintains the original, signed copies of the MOA.<br />
3. State, on behalf of the participating agency, may include agency-specific additions or revisions into the<br />
MOA before issuing it. Both State and the agency must agree in advance to any additions or revisions to<br />
the Model MOA.<br />
4. Copies of agency-specific MOAs already processed and in effect are on the HR/OE intranet website.<br />
Memorandum of Agreement Regarding the Department of State's<br />
Overseas Personal Services Agreement Authority<br />
I. Purpose<br />
This Memorandum of Agreement between the DEPARTMENT OF STATE (DOS) and<br />
_________________(the “Participating Agency”), sets forth the terms and conditions under which the<br />
Department of State will exercise the authority contained in 22 USC 2669 (n), hereinafter referred to as<br />
Personal Services Agreement (PSA) authority, on behalf of the Participating Agency.<br />
II. Applicability and Definitions<br />
This agreement applies to <strong>Local</strong>ly Employed Staff (LE Staff), Family Members (US Citizen EFMs and<br />
non-US Citizen EFMs), and Members of Household (MOH) recruited locally by the Participating Agency<br />
and under Chief of Mission authority.<br />
LE Staff is the general term used for Foreign Service Nationals and locally hired US Citizens employed<br />
by a US Government agency under Chief of Mission authority, and compensated under Section 408 of the<br />
Foreign Service Act of 1980.
