5. Foreign National: A citizen of the host country, also sometimes referred to as a host country national.<br />
HR employs a Foreign National under a PSA except as noted in A and B below. A foreign national is<br />
Ordinarily Resident and compensated under the <strong>Local</strong> Compensation Plan.<br />
A. Employee is Enrolled under Civil Service Retirement (CSR)<br />
HR must not employ a foreign national currently under a direct-hire appointment with Civil<br />
Service Retirement under a PSA. A foreign national under CSR remains under a FSN direct- hire<br />
appointment until s/he permanently stops working for the USG by resigning, retiring or other<br />
separation.<br />
B. Employee is Designated as Certifying Officer<br />
HR must employ a foreign national/LE Staff employee under a direct-hire appointment if the<br />
individual is designated as a Certifying Officer by the appropriate agency headquarters or State<br />
Department regional or function bureau.<br />
6. Ordinarily Resident <strong>Local</strong>ly Employed Staff: Host country nationals and other individuals (including<br />
US Citizens) who are not foreign nationals of the host country who have established residency in the host<br />
country and have the work permit, residency permit, or both the work and residency permits as required<br />
by host country labor law for legal employment in country. HR uses a PSA to employ Ordinarily<br />
Resident LE Staff for State and participating agencies under COM authority that have signed the MOA to<br />
use State’s PSA authority except as noted in A below.<br />
A. Employee is Designated as Certifying Officer<br />
HR must employ an Ordinarily Resident LE Staff under a direct-hire appointment if the individual<br />
is designated as a Certifying Officer by the appropriate agency headquarters or State Department<br />
regional or function bureau.
