programmes, instruction manuals, etc. at GBPIHED. However, the authors shall have the<br />

right to use the material in her/his pr<strong>of</strong>essional capacity. As the traditional exception,<br />

GBPIHED shall not claim ownership <strong>of</strong> copyright on books <strong>and</strong> publications authored by<br />

GBPIHED personnel.<br />

iv. GBPIHED shall be the owner <strong>of</strong> copyright <strong>of</strong> work produced by non-GBPIHED<br />

personnel associated with any activity <strong>of</strong> GBPIHED with the intellectual contribution <strong>of</strong><br />

GBPIHED personnel. However, the authors shall have the right to use the material in<br />

her/his pr<strong>of</strong>essional capacity.<br />

6.3.4. Licensing <strong>of</strong> Intellectual Property<br />

6.3.4(A) Definition<br />

Licensing <strong>of</strong> intellectual property shall mean granting the licensee the right to utilise the<br />

intellectual property <strong>and</strong> to make, sell or use the resulting product(s) either for<br />

commercial/captive purpose or as otherwise agreed to.<br />

6.3.4(B) Method <strong>of</strong> Licensing<br />

Licensing <strong>of</strong> intellectual property involving transfer through format means shall be through<br />

specific contractual arrangements. For transfer <strong>of</strong> intellectual property through only one-time<br />

demonstration or supply <strong>of</strong> only drawings, reports, plans s<strong>of</strong>tware etc. licensing can be done<br />

through implied contractual agreement with no liabilities on GBPIHED (Annexure 6.V).<br />

6.3.4.(C) Channel <strong>of</strong> Licensing <strong>and</strong> associated ownership rights<br />

GBPIHED would be free to choose the channel <strong>of</strong> licensing/commercial utilisation <strong>of</strong> all<br />

unencumbered intellectual property generated, which could be either directly by the <strong>Institute</strong><br />

themselves, through the National Research Development Corporation (NRDC) or through any<br />

other Technology Transfer Agency (TTA) such as Consulting & Design Engineering<br />

Organisations, etc. Requisite approvals as per guidelines would be necessary in each case <strong>of</strong><br />

licensing <strong>of</strong> intellectual property.<br />

6.3.4(D) (a) Direct licensing by the <strong>Institute</strong><br />

Intellectual property that can be licensed directly by the <strong>Institute</strong> would comprise:<br />

i. unencumbered intellectual property not referred to NRDC.<br />

ii. all encumbered intellectual property developed under contract research (ref. chapter 6.1,<br />

para, 6.1.6).<br />

GBPIHED should clearly specify in the agreement their obligations <strong>and</strong> extant commitments to<br />

the licensee(s) in each case.<br />

Licensing <strong>of</strong> unencumbered intellectual property should be generally on non- exclusive basis.<br />

However, where despite publicity <strong>and</strong> conscious efforts for commercial utilization <strong>of</strong> such<br />

intellectual property, it has remained unlicensed for more than three years, it could thereafter, if<br />

deemed necessary be <strong>of</strong>fered on a limited exclusive basis to make it more attractive to<br />

users/clients.<br />
