• Intellectual property is created by individuals, or by groups <strong>of</strong> individuals, who are<br />

entitled to choose the course <strong>of</strong> disclosure; academic freedom <strong>of</strong> individuals is a<br />

higher priority than possible financial rewards.<br />

• There exists a historical tradition allowing authors to retain ownership <strong>of</strong><br />

intellectual property rights from textbooks <strong>and</strong> works <strong>of</strong> art.<br />

• GBPIHED is the support <strong>of</strong> the entire <strong>Institute</strong> community along with its units <strong>and</strong><br />

is thereby entitled to share in financial rewards.<br />

• There should be incentives for all parties to pursue financial rewards together,<br />

consistent with the expressed goals <strong>of</strong> the policy. The distribution <strong>of</strong> these rewards<br />

should reflect, ins<strong>of</strong>ar as possible, the creative contributions <strong>of</strong> the creator, <strong>and</strong> the<br />

resources contributed by <strong>and</strong> risks assumed by both the creator <strong>and</strong> the GBPIHED<br />

in developing intellectual property.<br />

• Since it is frequently difficult to meaningfully assess risks, resources <strong>and</strong> potential<br />

rewards, negotiated agreements are to be encouraged whenever possible.<br />

Strategy<br />

The goals <strong>of</strong> GBPIHED's IP policy are to be achieved by:<br />

1. Nurturing a strong innovation base in the GBPIHED through a balanced<br />

system <strong>of</strong> recognition <strong>and</strong> rewards ranging from according due weightage in<br />

promotions to monetary <strong>and</strong> other forms <strong>of</strong> rewards.<br />

2. Investing liberally to enhance the skills <strong>and</strong> knowledge base <strong>of</strong> scientists,<br />

through structured in-house <strong>and</strong> external pr<strong>of</strong>essional training programmes,<br />

some even abroad, on underst<strong>and</strong>ing, interpreting <strong>and</strong> analyzing the technolegal<br />

<strong>and</strong> business information contained in IP documents <strong>and</strong> in drafting <strong>of</strong> IP<br />

documents.<br />

3. Strengthening the IPC <strong>of</strong> GBPIHED through infusion <strong>of</strong> qualified <strong>and</strong> trained<br />

staff, empanelment <strong>of</strong> outst<strong>and</strong>ing consultants <strong>and</strong> a high level advisory<br />

committee to enable it to develop as a centre <strong>of</strong> excellence <strong>and</strong> a national<br />

resource for intellectual property.<br />

4. Identifying <strong>and</strong> mounting applied research projects after thorough analysis <strong>and</strong><br />

assessment <strong>of</strong> techno-legal <strong>and</strong> business information in related IP documents<br />

<strong>and</strong> monitoring the global patent position for mid-term project appraisal for<br />

which requisite pre-project budget <strong>and</strong> funds would be allocated.<br />

5. Establishing <strong>and</strong> enforcing a formal mechanism <strong>of</strong> recording <strong>and</strong> authentication<br />

<strong>of</strong> R&D output / results taking into account the individual characteristics <strong>of</strong><br />

each core/unit <strong>and</strong> its activities, that would be accepted <strong>and</strong> respected by the<br />

patenting authorities the world over.<br />

6. Encourage the publication <strong>of</strong> R&D results in scientific papers after careful<br />

consideration <strong>of</strong> the consequences <strong>of</strong> IP rights. A quick <strong>and</strong> effective system at<br />

<strong>Institute</strong> would be established to scrutinize the scientific papers <strong>and</strong> media<br />

releases on achievements/ developments proposed in terms <strong>of</strong> the IP<br />

information contained therein.<br />
