<str<strong>on</strong>g>Attacks</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> <strong>Press</strong> <strong>in</strong> <strong>2010</strong>group. Defense lawyer Serkan Akbas <strong>to</strong>ld CPJ that Hess wrote articles <strong>in</strong>July and August detail<strong>in</strong>g alleged Turkish army violati<strong>on</strong>s aga<strong>in</strong>st Kurds,<strong>in</strong>clud<strong>in</strong>g ars<strong>on</strong> attacks and violence aga<strong>in</strong>st women. Hess was deportedafter n<strong>in</strong>e days <strong>in</strong> cus<strong>to</strong>dy and banned from re-enter<strong>in</strong>g <strong>the</strong> country.Authorities have also rout<strong>in</strong>ely prosecuted journalists <strong>on</strong> <strong>in</strong>sult chargesc<strong>on</strong>ta<strong>in</strong>ed <strong>in</strong> <strong>the</strong> penal code. Haci Bogatek<strong>in</strong>, owner and edi<strong>to</strong>r of <strong>the</strong>biweekly Gerger Firat, was c<strong>on</strong>victed <strong>in</strong> March <strong>on</strong> charges of <strong>in</strong>sult<strong>in</strong>g stateprosecu<strong>to</strong>rs and sentenced <strong>to</strong> five years <strong>in</strong> pris<strong>on</strong>. Bogatek<strong>in</strong> <strong>to</strong>ld CPJ thatauthorities targeted him after he published a January 2008 piece suggest<strong>in</strong>gthat Turkey faced a greater threat from a religious movement led by c<strong>on</strong>servativeauthor and cleric Fethullah Gülen than it did from <strong>the</strong> outlawedPKK. Bogatek<strong>in</strong> was free <strong>in</strong> late year pend<strong>in</strong>g appeal.<strong>Journalists</strong> and edi<strong>to</strong>rs from across <strong>the</strong> political spectrum were targetedfor <strong>the</strong>ir coverage of <strong>the</strong> Ergenek<strong>on</strong> c<strong>on</strong>spiracy. Büşra Erdal and MelihDuvakli, reporters for <strong>the</strong> pro-government Zaman, and Hel<strong>in</strong> Şah<strong>in</strong>, a reporterfor <strong>the</strong> pro-government Star, each faced multiple charges of violat<strong>in</strong>gstate secrets <strong>in</strong> <strong>the</strong>ir coverage of <strong>the</strong> case, <strong>in</strong> which prom<strong>in</strong>ent militaryand political figures were accused of c<strong>on</strong>spir<strong>in</strong>g aga<strong>in</strong>st <strong>the</strong> government.The European Court ruled <strong>in</strong> September that Turkey failed <strong>to</strong> protect<strong>the</strong> life and free expressi<strong>on</strong> rights of <strong>the</strong> Turkish-Armenian edi<strong>to</strong>r HrantD<strong>in</strong>k, who was shot outside his office <strong>in</strong> 2007 after receiv<strong>in</strong>g numerousdeath threats. D<strong>in</strong>k had angered ultranati<strong>on</strong>alists by tackl<strong>in</strong>g identity issuesof Turkish-Armenians, <strong>the</strong> Armenian orig<strong>in</strong>s of <strong>on</strong>e of Ataturk’s adopteddaughters, and <strong>the</strong> role of Ot<strong>to</strong>man Turkey <strong>in</strong> <strong>the</strong> World War I kill<strong>in</strong>gs ofArmenians. D<strong>in</strong>k <strong>to</strong>ld authorities that he had received death threats, but<strong>the</strong> European Court found that “n<strong>on</strong>e of <strong>the</strong> three authorities <strong>in</strong>formed of<strong>the</strong> planned assass<strong>in</strong>ati<strong>on</strong> and its imm<strong>in</strong>ent realizati<strong>on</strong> had taken acti<strong>on</strong> <strong>to</strong>prevent it.” The court also ruled that “no effective <strong>in</strong>vestigati<strong>on</strong> had beencarried out <strong>in</strong><strong>to</strong> <strong>the</strong> failures which occurred <strong>in</strong> protect<strong>in</strong>g <strong>the</strong> life” of <strong>the</strong>edi<strong>to</strong>r. As <strong>2010</strong> drew <strong>to</strong> a close, nearly four years after D<strong>in</strong>k’s assass<strong>in</strong>ati<strong>on</strong>,<strong>the</strong> government had yet <strong>to</strong> obta<strong>in</strong> a c<strong>on</strong>victi<strong>on</strong> <strong>in</strong> <strong>the</strong> case.Accused gunman Ogun Samast and two alleged accomplices rema<strong>in</strong>ed<strong>in</strong> cus<strong>to</strong>dy <strong>in</strong> late year, while several police, <strong>in</strong>telligence, and military officialsfaced charges of negligence <strong>in</strong> <strong>the</strong> case. In Oc<strong>to</strong>ber, Samast’s lawyerpersuaded a court <strong>to</strong> have his client tried as a juvenile offender, a changeopposed by D<strong>in</strong>k’s lawyers. Samast was 17 when he allegedly carried out<strong>the</strong> kill<strong>in</strong>g.<strong>Journalists</strong> and human rights defenders welcomed <strong>the</strong> European Court’srul<strong>in</strong>g, not<strong>in</strong>g that <strong>the</strong> D<strong>in</strong>k murder casts a dark cloud over <strong>the</strong> government’scommitment <strong>to</strong> press freedom and <strong>the</strong> rule of law. The Turkish ForeignM<strong>in</strong>istry said <strong>in</strong> a statement that it would not c<strong>on</strong>test <strong>the</strong> European266
