<str<strong>on</strong>g>Attacks</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> <strong>Press</strong> <strong>in</strong> <strong>2010</strong>would lift a legal cloud over more than a dozen o<strong>the</strong>r journalists who hadbeen charged with sediti<strong>on</strong> <strong>in</strong> recent years (<strong>in</strong>clud<strong>in</strong>g, most recently, <strong>the</strong>Uganda Record’s Kalyegira). Prosecuti<strong>on</strong> of sediti<strong>on</strong> cases has been stayedwhile <strong>the</strong> c<strong>on</strong>stituti<strong>on</strong>al challenge is pend<strong>in</strong>g.Mwenda, founder of The Independent, did not persuade <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>alCourt <strong>to</strong> strike down <strong>the</strong> charge of “promot<strong>in</strong>g sectarianism” underUganda’s penal code. Fac<strong>in</strong>g eight counts of “promot<strong>in</strong>g sectarianism,”<strong>the</strong> journalist planned <strong>to</strong> appeal. His lawyer, Nangwala, said <strong>the</strong> statute’slanguage is so vague that it can be used <strong>to</strong> silence critical report<strong>in</strong>g. “If areporter writes about a marg<strong>in</strong>alized ethnic group, for <strong>in</strong>stance, that can bec<strong>on</strong>sidered promot<strong>in</strong>g sectarianism,” he said.<strong>Journalists</strong> faced a new legal battle <strong>in</strong> March, when <strong>the</strong> governmen<strong>to</strong>utl<strong>in</strong>ed plans <strong>to</strong> amend <strong>the</strong> 1995 Ugandan <strong>Press</strong> and Journalist Act. As<strong>in</strong>itially proposed, <strong>the</strong> amendment would require newspapers <strong>to</strong> obta<strong>in</strong>licenses annually from a regula<strong>to</strong>ry agency known as <strong>the</strong> Media Council.Under <strong>the</strong> plan, <strong>the</strong> council could deny licenses <strong>to</strong> media houses based<strong>on</strong> such vague criteria as <strong>the</strong> “social, cultural, and ec<strong>on</strong>omic values of<strong>the</strong> newspaper” and <strong>the</strong> “proof of existence of adequate technical facilities.”The measure would also impose f<strong>in</strong>es and suspensi<strong>on</strong>s aga<strong>in</strong>st mediahouses that “publish material prejudicial <strong>to</strong> nati<strong>on</strong>al security, stability,and unity” and material “tantamount <strong>to</strong> ec<strong>on</strong>omic sabotage.” On World<strong>Press</strong> Freedom Day <strong>in</strong> May, scores of journalists marched <strong>in</strong> Kampala <strong>to</strong>denounce <strong>the</strong> proposal, accord<strong>in</strong>g <strong>to</strong> local reports. Informati<strong>on</strong> M<strong>in</strong>isterKabakumba Masiko <strong>to</strong>ld CPJ <strong>in</strong> September that <strong>the</strong> government was will<strong>in</strong>g<strong>to</strong> compromise <strong>on</strong> <strong>the</strong> proposed language and said it would c<strong>on</strong>sultmedia representatives before present<strong>in</strong>g a formal bill <strong>to</strong> parliament. Themeasure’s vague clause <strong>on</strong> “ec<strong>on</strong>omic sabotage” could fur<strong>the</strong>r impedereport<strong>in</strong>g <strong>on</strong> recently discovered oil reserves <strong>in</strong> <strong>the</strong> western part of <strong>the</strong>country. Independent journalists reported <strong>on</strong>go<strong>in</strong>g difficulty <strong>in</strong> obta<strong>in</strong><strong>in</strong>gdocuments and <strong>in</strong>formati<strong>on</strong> related <strong>to</strong> oil explorati<strong>on</strong>.As <strong>the</strong> 2011 presidential and parliamentary electi<strong>on</strong>s crept closer,journalists cover<strong>in</strong>g oppositi<strong>on</strong> candidates were targeted by operatives for<strong>the</strong> rul<strong>in</strong>g Nati<strong>on</strong>al Resistance Movement (NRM). The Kalangala Acti<strong>on</strong>Plan—a militia that journalists said had l<strong>in</strong>ks <strong>to</strong> <strong>the</strong> government—abductedand assaulted edi<strong>to</strong>r Moses Kasibante dur<strong>in</strong>g midterm parliamentaryvot<strong>in</strong>g <strong>in</strong> Muk<strong>on</strong>o North <strong>in</strong> May, <strong>the</strong> journalist <strong>to</strong>ld CPJ. Kasibante, an edi<strong>to</strong>rfor Ggwanga, a Luganda-language weekly, was c<strong>on</strong>sidered a supporterof <strong>the</strong> oppositi<strong>on</strong> party candidate. Kasibante said militia members abductedhim at a poll<strong>in</strong>g stati<strong>on</strong> and <strong>to</strong>ok him <strong>to</strong> a house <strong>in</strong> Muk<strong>on</strong>a where <strong>the</strong>y<strong>in</strong>terrogated and beat him for two hours. CPJ documented seven o<strong>the</strong>rcases <strong>in</strong> which NRM officials or supporters assaulted journalists cover<strong>in</strong>goppositi<strong>on</strong> party activities.58
