Kenya, The National Accord and Reconciliation Act 2008<br />

areas <strong>of</strong> land under customary tenure, typically<br />

without <strong>in</strong>form<strong>in</strong>g or consult<strong>in</strong>g <strong>the</strong> customary<br />

tenants. Under President Jomo Kenyatta, a Kikuyu,<br />

<strong>the</strong> traditional owners <strong>of</strong> <strong>the</strong> annexed land<br />

were mostly Kalenj<strong>in</strong>s. The legal system has cont<strong>in</strong>uously<br />

failed to resolve land disputes or secure<br />

customary tenants’ rights to <strong>the</strong>ir land. People<br />

were thus <strong>of</strong>ten left with <strong>the</strong> only option <strong>of</strong> secur<strong>in</strong>g<br />

<strong>the</strong>ir land property by violent means. This led<br />

to deep tensions, which had ethnic dimensions<br />

and turned violent on a large scale after <strong>the</strong> presidential<br />

elections. 117<br />

General problems like high rates <strong>of</strong> unemployment,<br />

especially among <strong>the</strong> youth, and widespread<br />

poverty and <strong>in</strong>equitable distribution <strong>of</strong> resources<br />

added to <strong>the</strong> tensions with<strong>in</strong> <strong>the</strong> Kenyan<br />

population. Aga<strong>in</strong>, <strong>the</strong> <strong>in</strong>equality amongst <strong>the</strong><br />

population is l<strong>in</strong>ked to ethnicity. One manifestation<br />

<strong>of</strong> this is <strong>the</strong> fact that <strong>in</strong>fant mortality <strong>in</strong><br />

Nyanza Prov<strong>in</strong>ce is three times higher than <strong>in</strong><br />

Central Prov<strong>in</strong>ce. 118 The Kenyan National Dialogue<br />

and Reconciliation acknowledged that <strong>the</strong>se<br />

two factors are among <strong>the</strong> root causes that will<br />

need to be addressed <strong>in</strong> order to ensure long-term<br />

stability. The ethnic divisions along party l<strong>in</strong>es<br />

were <strong>in</strong>creased by <strong>the</strong> exploitation <strong>of</strong> deeply<br />

rooted ethnic prejudices <strong>in</strong> <strong>the</strong> election campaigns.<br />

One such prejudice concerns <strong>the</strong> practice<br />

<strong>of</strong> male circumcision, which is very important <strong>in</strong><br />

Kikuyu and Bantu communities, but not practiced<br />

by Luos. PNU leaders attacked Od<strong>in</strong>ga<br />

publicly based on <strong>the</strong> fact that he was not circumcised.<br />

The first <strong>of</strong>ficial mediation mission to Kenya was<br />

led by <strong>the</strong> chairman <strong>of</strong> <strong>the</strong> <strong>African</strong> Union (AU)<br />

and president <strong>of</strong> Ghana, John Kufuor, who arrived<br />

<strong>in</strong> Kenya on 8 January 2008. He presented<br />

a document propos<strong>in</strong>g steps to be taken to resolve<br />

<strong>the</strong> crisis, which was to be signed by Kibaki and<br />

Od<strong>in</strong>ga. The two ma<strong>in</strong> po<strong>in</strong>ts were <strong>the</strong> follow<strong>in</strong>g:<br />

first, an <strong>in</strong>dependent <strong>in</strong>vestigation <strong>in</strong>to <strong>the</strong> electoral<br />

dispute was to be carried out, <strong>in</strong> order to determ<strong>in</strong>e<br />

whe<strong>the</strong>r a rerun <strong>of</strong> <strong>the</strong> election was necessary.<br />

The parties were to agree to be bound by<br />

<strong>the</strong> f<strong>in</strong>d<strong>in</strong>gs <strong>of</strong> <strong>the</strong> <strong>in</strong>vestigation. Secondly,<br />

should this be <strong>the</strong> case, an <strong>in</strong>terim government<br />

would be set up on a power-shar<strong>in</strong>g basis between<br />

<strong>the</strong> PNU and <strong>the</strong> ODM for <strong>the</strong> period up to <strong>the</strong><br />

rerun. The document was refused by <strong>the</strong> PNU,<br />

which rejected <strong>the</strong> option <strong>of</strong> a possible rerun,<br />

lead<strong>in</strong>g to <strong>the</strong> failure <strong>of</strong> Kufuor’s mission. 120 Before<br />

<strong>the</strong> end <strong>of</strong> his mission, Kufuor announced<br />

<strong>the</strong> transfer <strong>of</strong> <strong>the</strong> mediation process to a Panel <strong>of</strong><br />

Em<strong>in</strong>ent <strong>African</strong> Personalities, led by former UN<br />

secretary-general K<strong>of</strong>i Annan.<br />

Negotiation Phase<br />

<strong>Mediation</strong> Team and Third-party<br />

Coord<strong>in</strong>ation<br />

The <strong>African</strong> Union named a Panel <strong>of</strong> Em<strong>in</strong>ent<br />

<strong>African</strong> Personalities to mediate between <strong>the</strong> conflict<br />

parties <strong>in</strong> Kenya and resolve <strong>the</strong> national crisis.<br />

The panel consisted <strong>of</strong> former UN secretarygeneral<br />

K<strong>of</strong>i Annan, who was <strong>in</strong> <strong>the</strong> lead; former<br />

president <strong>of</strong> Tanzania Benjam<strong>in</strong> W. Mkapa; and<br />

Graça Machel, president <strong>of</strong> <strong>the</strong> Foundation for<br />

Community Development (FDC) <strong>in</strong> Mozambique.<br />

They were assisted by two staff members<br />

<strong>of</strong> <strong>the</strong> Geneva-based Centre for Humanitarian<br />

Dialogue (HD), who provided direct support and<br />

strategic advice. 121<br />

The panel ga<strong>in</strong>ed its authority from <strong>the</strong> moral<br />

stand<strong>in</strong>g <strong>of</strong> its <strong>in</strong>dividual members. Despite <strong>the</strong>ir<br />

dist<strong>in</strong>guished careers <strong>in</strong> <strong>in</strong>ternational relations,<br />

politics, and diplomacy, <strong>the</strong> three panel members<br />

did not undergo extensive tra<strong>in</strong><strong>in</strong>g <strong>in</strong> <strong>the</strong> technical<br />

mediation approaches used <strong>in</strong> <strong>the</strong> West. In<br />

technical matters, <strong>the</strong>y were assisted by personnel<br />

<strong>of</strong> <strong>the</strong> HD centre as well as a panel <strong>of</strong> em<strong>in</strong>ent<br />

Kenyans. This division <strong>of</strong> roles between <strong>the</strong> lead<br />

figures, who ensured <strong>the</strong> acceptance and legiti-<br />
