AN EQUALITY AND HUMAN RIGHTS IMPACTASSESSMENT1. IntroductionThis final section includes an equality analysis of the proposed merger in the light ofevidence included in the previous two sections (the Baseline Review <strong>and</strong> Local StakeholdersViews). In particular, brap were asked to:examine the impact of the merger on health inequalities in North East London <strong>and</strong> on thethree arms of the public equality duty in relation to protected characteristics as definedby the Actdescribe the negative <strong>and</strong> positive impacts of the merger (<strong>and</strong> who these will affect) <strong>and</strong>central issues that need to be addressed to mitigate the negative impactsidentify steps the merged trust can take to achieve compliance with its PSED in light ofconclusions of analysis of baseline data <strong>and</strong> stakeholder consultationfocus on equality <strong>and</strong> human rightsIn addition to this, following discussion with the project working group, brap were informedthat the merged Trust is likely to pursue the (non-m<strong>and</strong>atory) <strong>Equality</strong> Delivery System(EDS) for the NHS in the future. The three Trusts have not used the EDS this year <strong>and</strong> arewaiting for the proposed merger to happen before initiating work on this. Although this hasyet to be confirmed, the EDS is likely to help shape the equality <strong>and</strong> human rights relatedwork of the merged Trust going forward.2. ApproachThe brief for this equality <strong>and</strong> human rights analysis is a relatively complex one. It requiresanalysis to focus on both equality <strong>and</strong> human rights. It also needs to be useful for themerged Trust going forward (helping them to respond to the Public Sector <strong>Equality</strong> Duty <strong>and</strong>potentially the NHS EDS). A bespoke approach to undertaking the analysis was required<strong>and</strong> this is described below:EDS Goals were used to structure the scope of this equality analysis as it was felt the fourbroad goals provided sufficient scope to cover issues encountered through our research <strong>and</strong>were relevant to the equality <strong>and</strong> human rights implications of the merger. Within those fourbroad EDS goals there are an additional 18 detailed outcomes that were also used to guideenquiry (though the equality analysis below does not refer to these more detailed outcomesspecifically). This approach was chosen to provide the Trust with a useful ‘head start’ indeveloping its future response to the EDS. It would help signpost the merged Trust to keyequality <strong>and</strong> human rights issues relevant to each EDS goal.189
