UNIVERSITY POLICIESStudent Classification for Admission, Tuition,and Charge Differential Purposes(Approved by the Board <strong>of</strong> Regents August 28, 1990; AmendedJuly 10, 1998; Amended November 27, 2000; Amended April11, 2003)I. PolicyIt is the policy <strong>of</strong> the Board <strong>of</strong> Regents <strong>of</strong> the <strong>University</strong>System <strong>of</strong> <strong>Maryland</strong> (USM) to recognize the categories <strong>of</strong>in-state and out-<strong>of</strong>-state students for the purpose <strong>of</strong> admission,tuition, and charge differentials at those institutionswhere such differentiation has been established.A. An in-state student is a student whom the universitydetermines to be a permanent resident <strong>of</strong> the state <strong>of</strong><strong>Maryland</strong>. For the purposes <strong>of</strong> this policy, “permanentresident” is defined as a person who satisfies all the followingconditions and has done so for at least twelve (12)consecutive months immediately prior to and includingthe last date available to register for courses in the semester/termfor which the person seeks in-state status:1. Is not residing in the state <strong>of</strong> <strong>Maryland</strong> primarilyto attend an educational institution;2. Owns and continuously occupies or rents and continuouslyoccupies living quarters in <strong>Maryland</strong>.There must exist a genuine deed or lease in theindividual’s name reflecting payments/rents andterms typical <strong>of</strong> those in the community at thetime executed. Persons not having such a leasemay submit an affidavit reflecting payments/rentsand terms, as well as the name and address <strong>of</strong> theperson to whom payments are made that may beconsidered as meeting this condition. As an alternativeto ownership or rental <strong>of</strong> living quarters in<strong>Maryland</strong>, a student may share living quarters in<strong>Maryland</strong> that are owned or rented and occupiedby a parent, legal guardian, or spouse;3. Maintains within <strong>Maryland</strong> substantially all personalproperty;4. Pays <strong>Maryland</strong> income tax on all earned taxableincome, including all taxable income earned outsidethe state;5. Registers all owned motor vehicles in <strong>Maryland</strong> inaccordance with <strong>Maryland</strong> law;6. Possesses a valid <strong>Maryland</strong> driver’s license, iflicensed, in accordance with <strong>Maryland</strong> law;7. Is registered in <strong>Maryland</strong>, if registered to vote;8. Receives no public assistance from a state other thanthe state <strong>of</strong> <strong>Maryland</strong> or from a city, county, ormunicipal agency other than one in <strong>Maryland</strong>; and9. Has a legal ability under federal and <strong>Maryland</strong> lawto live permanently without interruption in<strong>Maryland</strong>.B. In addition, persons with the following status shall beaccorded the benefits <strong>of</strong> in-state status for the periodin which they hold such status:1. A full-time or part-time (at least 50-percent-time)regular employee <strong>of</strong> the USM.2. The spouse or financially dependent child <strong>of</strong> afull-time or part-time (at least 50-percent-time)regular employee <strong>of</strong> the USM.3. A full-time active member <strong>of</strong> the Armed Forces<strong>of</strong> the United States whose home <strong>of</strong> residency is<strong>Maryland</strong> or one who resides or is stationed in<strong>Maryland</strong>, or the spouse or a financially dependentchild <strong>of</strong> such a person.4. For UMUC, a full-time active member <strong>of</strong> theArmed Forces <strong>of</strong> the United States on active dutyor the spouse <strong>of</strong> a member <strong>of</strong> the Armed Forces <strong>of</strong>the United States on active duty.5. A graduate assistant appointed through the USMfor the semester/term <strong>of</strong> the appointment. Exceptthrough prior arrangement, this benefit is availableonly for enrollment at the institution awarding theassistantship.C. Students not entitled to in-state status under the precedingparagraphs shall be assigned out-<strong>of</strong>-state statusfor admission, tuition, and charge-differential purposes.D. Assignment <strong>of</strong> in-state or out-<strong>of</strong>-state classification willbe made by the university upon an assessment <strong>of</strong> thetotality <strong>of</strong> facts known or presented to it. The personseeking in-state status shall have the burden <strong>of</strong> provingthat he or she satisfies all requirements.E. Either <strong>of</strong> the following circumstances raise a presumptionthat the student is residing in the state <strong>of</strong> <strong>Maryland</strong>primarily for the purpose <strong>of</strong> attending an educationalinstitution:1. The student was attending high school or residingoutside <strong>Maryland</strong> at the time <strong>of</strong> application foradmission to a USM institution, or2. The student is both (a) not financially independentand (b) is financially dependent upon a personwho is not a resident <strong>of</strong> <strong>Maryland</strong>.The burden shall be on the student to rebut thepresumption.156GRADUATE <strong>CATALOG</strong> | 2008–2009
II.ProceduresA. An initial determination <strong>of</strong> in-state status will be madeby the university at the time a student’s application foradmission is under consideration. The determinationmade at that time, and any determination made thereafter,shall prevail for each semester/term until the determinationis successfully challenged in a timely manner.B. A change in status must be requested by submittinga USM “Petition for Change in Classification forAdmission, Tuition, and Charge Differential.” A studentapplying for a change to in-state status must furnishall required documentation with the petition bythe last published date to register for the forthcomingsemester/term for which the change in classification issought.C. The student shall notify the institution in writing withinfifteen (15) days <strong>of</strong> any change in circumstances thatmay alter in-state status.D. In the event incomplete, false, or misleading informationis presented, the institution may, at its discretion,revoke in-state status and take disciplinary action providedfor by the institution’s policy. Such action mayinclude suspension or expulsion. If in-state status isgained due to false or misleading information, theuniversity reserves the right to retroactively assess allout-<strong>of</strong>-state charges for each semester/term affected.E. Each institution <strong>of</strong> the USM shall develop and publishadditional procedures to implement this policy.Procedures shall provide that on request the presidentor designee has the authority to waive any residencycriterion set forth in Section I if it is determined thatthe student is indeed a permanent resident and theapplication <strong>of</strong> the criteria creates an unjust result.These procedures shall be filed with the Office <strong>of</strong>the Chancellor.B. Financially Independent: A financially independentstudent is one who (1) declares himself or herself to befinancially independent as defined herein; (2) does notappear as a dependent on the federal or state incometax return <strong>of</strong> any other person; (3) receives less thanone-half <strong>of</strong> his or her support from any other person orpersons; and (4) demonstrates that he or she providesthrough self-generated support one-half or more <strong>of</strong> hisor her total expenses.C. Parent: A parent may be a natural parent, or, if establishedby a court order recognized under the law <strong>of</strong> thestate <strong>of</strong> <strong>Maryland</strong>, an adoptive parent.D. Guardian: A guardian is a person so appointed by acourt order recognized under the law <strong>of</strong> the state <strong>of</strong><strong>Maryland</strong>.E. Spouse: A spouse is a partner in a legally contractedmarriage.F. Child: A child is a natural child or a child legallyadopted pursuant to a court order recognized under thelaw <strong>of</strong> <strong>Maryland</strong>.G. Self-Generated: Self-generated describes income that isderived solely from compensation for an individual’sown efforts as evidenced, for example, by federal orstate W-2 forms or IRS Form 1099, where interestincome is based upon finances created from one’s ownefforts. For the purposes <strong>of</strong> this policy, grants, stipends,awards, benefits, loans, and gifts (including federal andstate aid, grants, and loans) may not be used as selfgeneratedincome.H. Regular Employee: A regular employee is a person employedby the USM who is assigned to a state budgetline or who is otherwise eligible to enroll in a stateretirement system. Examples <strong>of</strong> categories not consideredregular employees are graduate students, contingentemployees, and independent contractors.III. DefinitionsA. Financially Dependent: For the purposes <strong>of</strong> this policy,a financially dependent student is one who is claimedas a dependent for tax purposes or who receives morethan one-half <strong>of</strong> his or her support from another personduring the twelve- (12-) month period immediatelyprior to the last published date for registration for thesemester or session. If a student receives more thanone-half <strong>of</strong> his or her support in the aggregate frommore than one person, the student shall be consideredfinancially dependent on the person providing thegreater amount <strong>of</strong> support.IV. ImplementationThis policy as amended by the Board <strong>of</strong> Regents onNovember 27, 2000, shall be applied to all student residencyclassification decisions made on or after this date.www.umuc.edu/grad 157
