<strong>Resolution</strong> <strong>of</strong> <strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Jersey</strong> <strong>City</strong>, N.J.<strong>City</strong> Clerk File No. Res. 09-903Agenda No.10.Z.6Approved: OCT 2 8 2009TITLE:00'.poRESOLUTION AUTHORIZING A CONTRACT WITH DIETRICH NEUMAHRPROVIDE FOUR K-9 DETECTIONIPOLICE PATROL DOGS TO THE JERSEY CITYPOLICE DEPARTMENT AND OFFICE OF EMERGENCY MANAGEMENTCOUNCILADOPTION OF THE FOLLOWIG RESOLUTION:OFFERED AND MOVEDPolice (Deparment) andEmergency Management desire to expand it's K-9 Unit for bomb detection and patrolHomeland Security; andWHEREAS, <strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Jersey</strong> <strong>City</strong> (<strong>City</strong>) through its Deparment <strong>of</strong>Offce <strong>of</strong>capabilities though fuding provided by <strong>the</strong> U.S. Deparment <strong>of</strong>WHEREAS, <strong>the</strong> Deparent has informally solicited two quotations in accordance withN.J.S.A 40A: 11-6. L.;andWHEREAS, Dietrich Neumah, 9 Strang Road, Derby, CT 06418, is an experienced dog breederwho specializes in providing dogs to law enforcement agencies and provided <strong>the</strong> lowestquotation to <strong>the</strong> Deparment; andWHEREAS, <strong>the</strong> Deparent has experience with Dietrich Neumah and o<strong>the</strong>r New <strong>Jersey</strong> lawenforcement agencies have recommended Dietrich Neumah as <strong>the</strong> breeder for law enforcementdogs; andWHEREAS, <strong>the</strong> Deparent has received a quotation in accordance with N.J.S.A. 40A: 11-6.1.to provide four (4) German Sheperds from Dietrich Neumah for a cost <strong>of</strong> $20,800.00; andWHEREAS, Sgt. W. Greg Kierce, OEM Coordinator for <strong>the</strong> <strong>City</strong>, reviewed Dietrich Neumahr'sproposal from Dietrich Neumah and certifies it is fair and reasonable; andWHEREAS, <strong>the</strong> sum <strong>of</strong> $20,800.00 is available in Account No. 1 0-02-213-40-972-2 i 8; andWHEREAS, <strong>the</strong> <strong>City</strong> is acquiring <strong>the</strong>se services directly and openly as a statutorily permittedcontract pursuat to <strong>the</strong> provisions <strong>of</strong>N.J.S.A. 19:44A-20.5 (Pay-to-Play Law); andWHEREAS, <strong>the</strong> Police Director has determned and certified in writing that <strong>the</strong> value <strong>of</strong> <strong>the</strong>contract will exceed $17,500; andWHREAS, Dietrich Neumah has completed and submitted a Business Entity DisclosureCertification which certifies that Dietrich Neumah has not made any reportable contributions to<strong>the</strong> political or candidate committees listed in <strong>the</strong> Business Entity Disclosure Certification in <strong>the</strong>previous one year (2005 contributions are exempt), and that <strong>the</strong> contract will prohibit DietrichNeumah from makng any reportble contributions during <strong>the</strong> term <strong>of</strong><strong>the</strong> contract; andWHREAS, Dietrch Neumah has submitted a Chapter 271 Political Contrbution DisclosureCertification at least 10 days prior to <strong>the</strong> award <strong>of</strong> this contract; and\ .,--~
