TO ENTER ONTO CITY-OWND PROPERTYKNOWNAS 880 GARFIELD AVENUE, 884 GARIELD A VENUE, 70 CARTERETSTREET, AND 2 DAKOTA STREETCOUNCILresolution:<strong>of</strong>fered and moved adoption <strong>of</strong> <strong>the</strong> followingWHEREAS, <strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Jersey</strong> <strong>City</strong> (<strong>City</strong>) owns real property known as Block 2026.1, Lot 2.Aa/k/a as 880 Garfield Avenue; Block 2026.1; Lot 4.A a/a 884 Garfield Avenue; Block 2026.i , Lot3.B a/k/a 70 Carteret Street; Block 2026.A, Lot 3.A a/k/a 2 Dakota Street (Properties); andWHEREAS, PPG Industries, Inc., a Pennsylvania Corporation (PPG), whose address is 1 PPGPlace, Pittsburgh, Pennsylvania 15272, entered into an Àdministrative Consent Order (ACO) on July19, 1990 with <strong>the</strong> New <strong>Jersey</strong> Departent <strong>of</strong> Environmental Protection (DEP), and a Partial ConsentJudgment effective June 26, 2009 pursuant to which PPG would be required to perform certaintesting, soil borings, groundwater testing and monitoring and remedial work on and in <strong>the</strong> Property;andWHEREAS, PPG requests <strong>the</strong> <strong>City</strong>'s permission to enter <strong>the</strong> Properties for <strong>the</strong> purpose <strong>of</strong>performing environmental testing and performing environmental remediation work; andWHEREAS, PPG needs access to <strong>the</strong> Properties to comply with <strong>the</strong> DEP's ACO and <strong>the</strong> PartialConsent Judgment which establishes a five year schedule for remediation; andWHEREAS, PPG desires to enter into a license agreement with <strong>the</strong> <strong>City</strong> for a term <strong>of</strong>effective as <strong>the</strong> date <strong>the</strong> license agreement is executed by <strong>City</strong> <strong>of</strong>fcials; andfive yearsWHEREAS, PPG agrees to execute <strong>the</strong> license agreement attached hereto to.NOW, THEREFORE, BE IT RESOLVED, by <strong>the</strong> Municipal Council <strong>of</strong>that:<strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Jersey</strong> <strong>City</strong>i.
