AGREEMENTThis Agreement dated the day of , 2009 between theScope of AgreementSpecial Counsel is hereby retained to perform legal services and represent Joseph Frankin the appeal of Nicole Dawson v. IosephFrank, for the period ofJuly 1,2009 through June 30, 2010.Affidavit of ServicesSpecial Counsel shall submit a monthly affidavit of services to the Corporation CounseL.The affidavit shall specify in detail the services rendered and the time spent on those services.ConsiderationA. For the above services, Special Counsel shall be compensated at the rate of$125.00 per hour, including expenses. The total amount of this agreement shall not exceed$10,000.B. The Special Counsel shall provide a monthly statement for services rendered.The Special Counsel shall submit to the City adminstration no later than the tenth day of eachmonth an affidavit of services specifying the total number of hours worked/performed duringthe preceding month.C. Special Counsel shall report to the Corporation Counsel when he or she has
iled 70% of total contract amount. Special Counsel shall not be paid for services unless priorapproval by the Corporation Counsel once Special Counsel reaches the 100% threshold.D. The Corporation Counsel reserves the right to terminate this agreement at anytime for any reason whatsoever. Upon termination, Special Counsel shall be paid for servicesrendered up tothe date of termination. Thereafter, this agreement shall be null and void withno further rights or obligations emanating therefrom.E. This agreement shall not become effective and Special Counsel shall provide noservices under this agreement until he or she has executed the following documents:(1) Minority/Woman Business Enterprise Questionnaire;(2) Procurement and Service Contracts, Language" A";(3) Mandatory Business Registration.Biling Practices and Other Guidelines ProceduresDisbursements should be charged only on the basis of the actual direct out-of-pocket costto the Special Counsel and biled with sufficient detail to permit assessment of their compliancewith the following guidelines: (I) in the case of photocopying, the per page charge not to exceedfifteen cents ($.15) per page; (ii) in the case of facsimile transmittal, the per page charge not toexceed one dollar and fifty cents ($1.50) per page; and (iii) charges for mileage and ,parking shallnot be charged to the City.The City expects that the Special Counsel wil need to obtain the services of third-partiessuch as court reporters, investigators, consultants, experts, title companies, appraisers, messengerservices, etc., in order to carry out their assignents and wil contract with those service providersupon the approval of the City. With the exception of the court reporters, Special Counsel shall
