RIGHT OF ENTRYRoute: 7 Wittpenn Bridge - Section: 1, Parcel: 39(More specifically know as Block 287, Lot 65 inthe Township of Kearny, New Jersey)Project: 100% StateOwner: City of Jersey CityTo: New Jersey Department of TransportationIn cooperation with the State, the Owner grants permission to enter upon the listed parcel(s) forthe purpose of constructing roadway improvements. The Owner hereby acknowledgesthat itvoluntarily relinquishes its known right to immediate payment on vacating ofthis right of entry.the premises withIt is understood thatthe State recognizes the cooperation ofthe Owner in grantingthis voluntarypermission of entry, and it is further understood that the State will proceed promptly withnegotiations, so that a settement based on a fair market value and just price can be reached,or in the event a settlement isnot reached, to promptly institute Eminent Domain proceedings,so thata fair and just reward can be rendered bya neutral commission as soon as possible.Subject to the provisions ofthe New Jersey Tort Claims Act, N.J.S.A. 59:1-1, et seq., and theavailability offunds, the Department of Transportation will be responsible for personal injuriesand property damage caused by the negligent acts of the Department, its employees andofficials which occur on the property identified in this Agreement. Any claim for such personalinjury or property damage must be filed in accordance with N.J.S.A. 59:8-1 et seq.The Owner shall not be relieved of any legal obligations resulting from the presence ofcontamination on the property, as of the date of closing or the date of vacation of theproperty by all occupants, Whichever is later.The Jersey City Water Engineer must be notified atleast five (5) working days prior to thecommencement of any work on the property. All plans and specifications must be approved bythe Jersey City Water Engineer. Any changes in the plans and specifications for work to be donemust be approved by the Jersey CityWater Engineer.
The State shall have the right of ingress and egress to the property and the passage of personsor vehicles in connection with such construction; provided, however, that the entering upon orcrossing of the property with heavy equipment is not permitted unless written permission isobtained from the Jersey City Water Engineer.Owner or AgentWitnessDateRobert M.
