<strong>Resolution</strong> <strong>of</strong> <strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Jersey</strong> <strong>City</strong>, N.J.<strong>City</strong> Clerk File No.Agenda No.Approved:Res. 09-905lO.l.BOCT 2 8 2009TITLE:RESOLUTION AUTHORIZING THE AWARD OF ACONTRACT TO OFFICIAL PAYMENTS, INC., FOR CREDITCAR AND ELECTRONIC PAYMENTS PROCESSINGCOUNCILOFFERED AND MOVED ADOPTION OF THEFOLLOWING RESOLUTION:WHREAS, <strong>the</strong> Tax Collector has <strong>the</strong> need to accept propert ta payments viacredit cards and o<strong>the</strong>r electronic means; andWHREAS, N.J.S.A. 40A:1l-4.1G) authorizes <strong>the</strong> <strong>City</strong> to use competitivecontracting to award contracts for concessions; andWHEREAS, <strong>the</strong> <strong>City</strong> Council approved resolution 09-655 on August 12, 2009,authorizing <strong>the</strong> use <strong>of</strong> competitive contracting for this purose; andVv'HREAS, <strong>the</strong> <strong>City</strong> advertised for bids pursuant to <strong>the</strong> Competitive ContractingLaw, N.J.S.A. 40A:11-4.1, and received proposals from Offcial Payments, Inc andRenaissance Associates; andWHREAS, Renaissance Associates did not include <strong>the</strong> mandated BusinessRegistration Certificate with its proposal and was <strong>the</strong>refore disqualified; andD.lt\' ~'iliy.v\\lfREAS, a commttee appointed by <strong>the</strong> Business Administrator, has reviewed<strong>the</strong> proposal from Offcial Payments, Inc and prepared a report attached hereto,recommending that <strong>the</strong> contract be awarded to Offcial Payments, Inc ; andWHEREAS, <strong>the</strong> proposal submitted.by Offcial Payments, Inc will be fuded byconvenience fees and will be at no cost to <strong>the</strong> <strong>City</strong>; andVv1fREAS, <strong>the</strong>, <strong>City</strong> Purchasing Agent has certified that he considers saidproposal to be fair and reasonable; andNOW, THEREFORE, BE IT RESOLVED, by <strong>the</strong> Municipal Council <strong>of</strong><strong>City</strong> <strong>of</strong> <strong>Jersey</strong> <strong>City</strong> that:<strong>the</strong>1) Pursuant to N.J.S.A. 40A: 11-4.1 ~~., a contract to provide credit card andelectronic payments processing be awarded to Offcial Payments, Inc.;2) Subject to such modification as deemed necessar or appropriate byCorporation Counel, <strong>the</strong> Mayor or Business Adrninistrator is authonzed toexecute an ageement prepared by <strong>the</strong> Purchasing Agent based on <strong>the</strong> termsand conditions <strong>of</strong> <strong>the</strong> <strong>City</strong>'s Request for Proposals document;
