CITY OF JERSEY CITYWHEREAS, Mathais Bolton fied a complaint in Federal District Court <strong>of</strong> New <strong>Jersey</strong> against<strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Jersey</strong> <strong>City</strong>, <strong>Jersey</strong> <strong>City</strong> Police Chief Tom Corney, Police Officer Kevin Hil andPolice Officer Victor Vargas alleging assault, false arrest and violation <strong>of</strong> his civil rights; andWHEREAS, <strong>the</strong> Corporation Counsel has determined that it is necessary to appoint outsidecounsel to represent Police Chief Tom Corney in this matter; andWHEREAS, <strong>the</strong> law firm <strong>of</strong> Florio & Kenny, LLP, 100 Hudson Street, Hoboken, New <strong>Jersey</strong>possesses <strong>the</strong> skills and expertise to perform <strong>the</strong>se services; andWHEREAS, special co~nsel agrees to provide <strong>the</strong>se services at an houdy rate <strong>of</strong> $125.00 perhour, including expenses, for a total amount not to exceed $75,000; andWHEREAS, N.I.S.A.19:44A-20.4 gl §g. (<strong>the</strong> Pay-to-Play Law) took effect on January 1, 2006; andWHEREAS, in March 2009, <strong>the</strong> <strong>City</strong> publicly advertised a Request for Qualifications (RFQ)'using<strong>the</strong> "fair and open process" as described under <strong>the</strong> Pay-to-Play Law; and ';" ;'/WHEREAS, Florio & Kenny, LLP submitted a Qualification Statement in response to <strong>the</strong> <strong>City</strong>'sRFQ;andWHEREAS, this contract is made in accordance with <strong>the</strong> "fair and open process" <strong>of</strong> <strong>the</strong> Pay-to-Play Law; andWHEREAS, Florio & Kenny, LLP submitted a Qualification Statement in response to <strong>the</strong> CitýsRFQ;andWHEREAS, <strong>the</strong> law firm <strong>of</strong> Florio & Kenny has completed and submitted a Business EntityDisclosure Certification which certifies that he has not made any reportable contributions to<strong>the</strong> political or candidate committees listed in <strong>the</strong> Business Entity Disclosure Certification in<strong>the</strong> previous one year, and that <strong>the</strong> contract wil prohibit Florio & Kenny, LLP from makingany reportable contributions during <strong>the</strong> term <strong>of</strong> <strong>the</strong> contract;andWHEREAS, Florio & Kenny, LLP has submitted a Chapter 271 Political Contribution DisclosureCertification at least 10 days prior to <strong>the</strong> award <strong>of</strong> this contract; andWHEREAS, Florio & Kenny, LLP has submitted its Certification <strong>of</strong> Compliance with <strong>the</strong> <strong>City</strong>'sContractor Pay-to-Play Reform Ordinance 08-128 adopted on September 3, 2008; andWHEREAS, fuds are available for <strong>the</strong> cost <strong>of</strong> <strong>the</strong>se services in Account No.: 10-14-298-56-000-856.WITHDRAWN
