agency or quasi-governmental body <strong>of</strong> any <strong>of</strong> <strong>the</strong> for~going or (iii) <strong>the</strong> goverrent (orany subdivision, instrumentality, department, agency or quasi-governmental body<strong>the</strong>re<strong>of</strong>) <strong>of</strong> any sovereign state.2.05 "Environmental Claims" means any Claim made in connection withEnvironmental Contamination. Environmental Claims include, without limitation, anyand all past, present or future Claims, that have been, could have been or may be assertedby or on behalf <strong>of</strong> any Person against <strong>the</strong> <strong>City</strong> or against any Person for ';hose acts oromissions <strong>the</strong> <strong>City</strong> is or may be liable, or against Travelers as an insurer <strong>of</strong> <strong>the</strong> <strong>City</strong>, orany actions taken by Travelers as an insurer <strong>of</strong> <strong>the</strong> <strong>City</strong>, or any actions taken by <strong>the</strong> <strong>City</strong>(voluntarily or o<strong>the</strong>iwise) that involve, arise out <strong>of</strong> or relate in any way to EnvironmentalContamination, including, without limitation: (i) Claims for or relating to bodily injury,personal injury or property damage (as those terms are defined in <strong>the</strong> Policies) or allegingany o<strong>the</strong>r rights to relief against <strong>the</strong> <strong>City</strong> that involve, arise out <strong>of</strong> or relate in any way toEnvironmental Contamination; (ii) Claims for or that relate to investigation, analysis,remediation, monitoring, testing, removal or clean-up <strong>of</strong> Environmental Contamination orto recover <strong>the</strong> costs associated <strong>the</strong>rewith; (iii) Claims for statutory fines or penalties; (iv)Claims for <strong>the</strong> recovery <strong>of</strong>damages for injury, destruction or damage to Persons,property (tangible or intangible) or natural resources that involve, arise out <strong>of</strong> or relate inany way to Environmental Contamination; and (v) Claims to obtain equitable, injunctiveor declaratory relief.2.06 ''Environmental Contamination" means <strong>the</strong> actual, alleged and/orpotential contamination, injury or damage <strong>of</strong> land, air, environment, atmosphere, soil,sediments, property (tangibleor intangible), natural resources, water (including, but notPage 4 <strong>of</strong>20
limited to, ground water, surface water or any o<strong>the</strong>r form or body <strong>of</strong>.water) or any Person(as defined herein), by, arising from or related to <strong>the</strong> presence, existence, movement,emission, discharge, seepage, release, disposal, dumping, landfiling or escape <strong>of</strong>pollutants, including, but not limited to, any contaminant, ini.tant, chemical, petroleum,petroleum related or derived product, asbestos, silica, lead, metal, PCBs, waste (includingbut not limited to materials intended to be recycled, reconditioned or reclaimed), smoke,vapor, soot, fumes, "hazardous wastes" as defined under <strong>the</strong> Resource Conservation andRecovery Act <strong>of</strong> 1976, as amended, "hazardoussubstances," "pollutant(s)" or"contaminant(s)" as defined by <strong>the</strong> Comprehensive Environmental Response,Compensation and Liability Act, as amended, 42 U.S.C. § 9601 et seq., "hazardousmaterials" as defined by <strong>the</strong> Hazardous Materials Transportation Act, as amended, "toxicsubstances" as defined by <strong>the</strong> Toxic Substances Control Act, as amended, or any o<strong>the</strong>rsubstance which substance is or is alleged to be, and whe<strong>the</strong>r or not known to be,harmful, noxious, nuisance causing or injurious.2.07 "Claim" means any and all actual, potential, threatened or alleged past,present, or future (1) claim, assertion <strong>of</strong> any right, obligation, liabilty, duty, complaint,cross-complaint, counterclaim, affimative defense, writ, demand, inquiry, request,lawsuit, action, cause <strong>of</strong> action, administrative proceeding, governmental action, statutoryor regulatory obligation, order, directive, arbitration, mediation, judgment, settlement, orlien, whe<strong>the</strong>r known or unknown, asserted or unasserted, foreseen or unforeseen, fixed orcontingent, direct or indirect, matured or unmatured, liquidated or nnliquidated andwhe<strong>the</strong>r in law, tort, contract, equity, nuisance, trespass, negligence, strict liability,admiralty or o<strong>the</strong>rwise, (including, but not limited to, any Claim (a) arising out <strong>of</strong>, relatedPage 5 <strong>of</strong>20
