TO ENTER ONTO CITY-OWNED PROPERTYKNOWNAS BLOCK 2006A, LOT 2 ALSO KNOWN AS 824 GARFIELD AVENUECOUNCILresolution:offered and moved adoption ofthe followingWHEREAS, the City of Jersey City (City) owns real propert known as Block l006.A, Lot 2, alsoknown as 824 Garfield Avenue (Propert); andWHEREAS, PPG Industries, Inc., a Pennsylvania Corporation (PPG), whose address is 1 PPGPlace, Pittsburgh, Pennsylvania i 5272, entered into an Administrative Consent Order (ACO) on July19, 1990 with the New Jersey Departent of Environ mental Protection (DEP), and a Partial ConsentJudgment effective June 26, 2009 pursuant to which PPG would be required to perform certaintesting, soil borings, groundwater testing and monitoring and remedial work on and in the Propert;andWHEREAS, PPG requests the City's permission to enter the Propert for the purpose of performingenvironmental testing and performing environmental remediation work; andWHEREAS, PPG needs access to the Propert to comply with the DEP's ACO and the PartialConsent Judgment which establishes a five year schedule for remediation; andWHEREAS, PPG desires to enter into a license agreement with the City for a term of five yearseffective as the date the license agreement is executed by City offcials; andWHEREAS, PPG agrees to execute the license agreement attached hereto to.NOW, THEREFORE, BE IT RESOLVED, by the Municipal Council ofthat:the City of Jersey Cityi. PPG, its contractors, and agents are authorized to enter onto the Propert for the purpose ofperforming the activities described in the license agreement attached hereto;2. subject to such modification as may be deemed necessary or appropriate by CorporationCounsel, the Mayor or Business Administrator is authorized to execute the license agreementattached hereto; and¡j,2.009119 ,.ß~:.
