ON SATURAY, OCTOBER31,2009 (RIN DATE: SUNAY, NOVEMBER 1,2009) AT THE REQUEST OFTHE HISTORIC PAULUS HOOK ASSOCIATION FOR THE PUROSE OF ASTREET MARKTIFUN RAISERWHEREAS, the Division of Engineering, Traffc & Transportation has received an application from the HistoricPaulus Hook Association to close Grand Street from Greene Street to Washington Street beginning 10: 00 a.m. and ending8:00 p.m. on Saturday, October 31, 2009 (rain date: Sunday, November I, 2009) for the purpose of a streetmarketlfindraiser; and 'WHEREAS, in accordance with the provisions of Section 296-71 and 296-72, a street may be temporarily closedfor a block part or any recreational event to be conducted within an area not exceeding one city block under certainconditions;WHEREAS, when one or more of the required conditions for a street closing are not met, in accordance withSections 296-74 (B) the Traffc Engineer may recommend to the City Council that one or more of the requirements ofSections 296-71, 296-72 and 296-73 be waived; andWHEREAS, the request to close Grand Street does not meet one or more of296-71(A)(B)(C)(D) and 296-73(D) as the application has been fied by a non-resident of the blockclosed; andthe requirements St;t forth in Sectionrequested to beWHEREAS, the closing of the aforementioned street will not affect public safety or convenience, and inaccordance with the provision of Section 296-74 (B) the applicant has made a request to the City Council that theaforementioned requirements set forth in Section 296-71 and 296-73 be waived.NOW THEREFORE IS IT RESOLVED, that the Municipal Council via adoption ofthis resolution authorizesthe closing of Grand Street from Greene Street to Washington Street beginning 10:00 a.m. and ending 8:00 p.m.,Saturday, October 31, 2009 (rain date: Sunday, November 1,2009).JDS:pcl(10.8.,09)plf,APPROVED AS TO LEGAL FORM-: =;corpo£r COUliSWCertification Required DNot RequiredRECOI\O OF COUNCIL VOTE ON FiNAL PASSAGEDAPPROVED 9-010/28 oqCOUNCILPERSON AYE NAY N.v, COUNCILPERSON AYE NAY N.V.
