TO DISCUSS PENDING LITIGATIONAND MATTERS WITHIN THE ATTORNEY CLIENTPRIVILEGE (SIXTH STREET EMBANKMENT)Council as a whole, <strong>of</strong>fered and moved adoption <strong>of</strong> <strong>the</strong> following:WHEREAS, <strong>the</strong> Open Public Meetigs Act, N.J.5.A. 10:5-1 et seq. (Act), authorizes agovernmental body to hold a closed session to discuss matters with <strong>the</strong> attorney clientprivilege; andWHEREAS, <strong>the</strong> Act requires that a closed session shall be authorized by resolution, whichshall indicate when <strong>the</strong> minutes <strong>of</strong> <strong>the</strong> closed session shall be released to <strong>the</strong> public; andWHEREAS, <strong>the</strong> Muncipal Council wii:hes to discuss matters "Ythi <strong>the</strong> attorney-clientprivilege, including, but not limted to <strong>the</strong> Sixth Street Embanment Litigation fied bycertain LLCs known as 212 Marin Boulevard, 247 Ma,nila Avenue, 317 <strong>Jersey</strong> Avenue, 354Cole Street, 389 Monmouth Street, 415 Brunswick Street and 44 Newark A venue, litigationin New <strong>Jersey</strong> and litigation filed on behalf <strong>of</strong> <strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Jersey</strong> <strong>City</strong> before <strong>the</strong> federalSurface Transportation Board; andNOW, THEREFORE, BE IT RESOLVED, by <strong>the</strong> Municipal Council <strong>of</strong> <strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Jersey</strong><strong>City</strong> that:1. A closed caucus <strong>of</strong> <strong>the</strong> Council wil be held on Tuesday, November 10, 2009 at 5:00p.m. to discuss matters with <strong>the</strong> attorney-client privilege. The meetig wil takeplace in <strong>the</strong> Efrai Rosario Memorial Council Caucus Room, second Floor, <strong>City</strong> Hall.2.
