RESOLUTION OF THE MUNICIPAL COUNCIL OF THE CITY OFJERSEY CITY DESIGNATING BLOCK 792, LOT 242 AS AN ARA IN NEED OFREHAILITATIONWHEREAS, <strong>the</strong> Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-14.a., providesthat <strong>the</strong> governing body <strong>of</strong> a muncipality may, by resolution, determine that a: delineated areais an "area in need <strong>of</strong> rehabilitation" if certain conditions are found to exist within <strong>the</strong>delineated area; andWHEREAS, among <strong>the</strong> conditions precedent to makg such a determination isa finding that"more than half <strong>of</strong> <strong>the</strong> housing stock. in <strong>the</strong> delineated area is at least 50 years old, or amajority <strong>of</strong> <strong>the</strong> water and sewer infrastrcture in <strong>the</strong> delineated area is more than 50 years oldand in need <strong>of</strong> repair and substantial maintenance;" andWHEREAS, <strong>the</strong> Municipal Council sought a review by, and recommendation <strong>of</strong>, <strong>the</strong> <strong>Jersey</strong><strong>City</strong> Planng Board, with regard to a determination that <strong>the</strong> delineated area, known as "TheGreater Joural Square Study Area" is an area in need <strong>of</strong>rehabilitation; andWHEREAS, <strong>the</strong> <strong>Jersey</strong> <strong>City</strong> Planng Board, at its meeting <strong>of</strong>November 4,2009, <strong>the</strong>Planng Board heard sworn testimony from Robert D. Cotter, PP, AICP, Planng Director,to <strong>the</strong> effect that <strong>the</strong> Chief Engineer to <strong>the</strong> Muncipal Utilities Authority had submitted awrtten report confirming that <strong>the</strong> majority <strong>of</strong><strong>the</strong> water and sewer inastructure in <strong>the</strong> StudyArea is more than 50 years old and would benefit from a program <strong>of</strong> repair and substatialmaintenance; andNOW, THEREFORE, BE IT RESOLVED by <strong>the</strong> Muncipal Council <strong>of</strong><strong>the</strong> <strong>City</strong> <strong>of</strong> <strong>Jersey</strong><strong>City</strong> that Block 792, Lot 242 be, and hereby is, determned to meet <strong>the</strong> criteria to be declared"an Area in Need <strong>of</strong> Rehabilitation."Robert D.
