quantity of alcoholic beverages which may be pro<strong>du</strong>ced and brought<br />
into its jurisdiction by a purchaser from another state <strong>with</strong>out requiring<br />
the purchaser, a seller or shipper to possess certain licenses or permits.<br />
The American Heart Association shall not, as a condition of sale, assume<br />
any obligations or bear any responsibility whatsoever for applying for or<br />
obtaining any permits or licenses in the event the quantity purchased<br />
exceeds said limitation.<br />
6. Therefore, all bidders are strongly advised to investigate the possibility of<br />
such limitations and determine the manner in which alcoholic beverages<br />
may legally be brought into a state from Texas so as to comply <strong>with</strong> all of said<br />
state’s requirements.<br />
7. A good faith estimate of “fair market value” for tax de<strong>du</strong>ctibility has been<br />
made by the American Heart Association as required by recent revisions<br />
to the IRS code. For federal income tax purposes, the amount of charitable<br />
de<strong>du</strong>ction is limited to the excess of the amount of the successful bid over<br />
the estimated “fair market value.” As a convenience to all bidders this value<br />
is listed in the catalog as the estimated value and it is written on the bid<br />
slip for each silent auction item. The Côtes <strong>du</strong> <strong>Coeur</strong> Committee and the<br />
American Heart Association, its officers, directors, employees and volunteers<br />
undertake or make no guarantee as to the ultimate validity of the estimate<br />
published, your realization of such values in the marketplace or their<br />
adequacy for taxing or regulatory authorities. Further, American Heart<br />
Association assumes no responsibility for the economic consequences of<br />
your use of your values.<br />
8. Delivery: The wines for Côtes <strong>du</strong> <strong>Coeur</strong> will be displayed at the Omni Dallas<br />
Hotel at the time of the auction. Purchases will be released to buyers by the<br />
American Heart Association <strong>with</strong> payment to the American Heart Association<br />
for purchases, appropriate taxes, if applicable. Bidders spending over<br />
$10,000 will receive free delivery courtesy of Delivery Limited. The American<br />
Heart Association requires all other buyers to pick up their wine(s) and other<br />
purchases. The American Heart Association and its agents cannot assume<br />
responsibility for conditions resulting from shipping or courier. The American<br />
Heart Association will not be responsible for any loss or breakage while in<br />
transit. Out-of-town buyers shall be responsible for arranging their<br />
own shipping.<br />
9. Packing: Certain modes of shipment require re-packing of wine from its<br />
original wooden cases. Out-of-town buyers should specify to the shipper if<br />
they wish to maintain wines in the original cases.<br />
10. Collection: Wines and other purchases not subject to the free delivery<br />
provided by Delivery Limited must be collected at the Omni Dallas Hotel<br />
between the end of the auction and the end of the next day. A representative<br />
from the American Heart Association will be present to receive proof of<br />
payment prior to the collection of wines and other items sold. In order to<br />
prevent delays, buyers are urged to go to the auction cashiers soon after the<br />
auction closes. Payment must be made the night of the event. Out-of-town<br />
buyers must arrange for proper collection of their wines <strong>with</strong>in 10 business<br />
days (May 5, <strong>2017</strong>).<br />
