Il sistema di monitoraggio nelle assurances nel caso Othman: il MOU edil Centro AdalehIl Memorandum d'Intesa (MOU) stipulato tra il Regno Unito e laGiordania altro non è che un documento contenente assurances. La primaparte è relativa ai diritti della persona interessata e le procedure da osservaredurante la detenzione. I paragrafi 1-4 del MOU sono riportati in seguito. Ilparagrafo 7 del MOU garantisce il diritto ad un equo processo con una formulazionesimile a quella dell'art. 6, co. 1, Cedu, mentre il paragrafo 8 riportatestualmente l'art.6, co. 3, Cedu, ad eccezione delle lettere (a) ed (e).La seconda parte dell'accordo prevede meccanismi di monitoraggioche, secondo i patti tra le due nazioni, spettava al Centro Adaleh (AdalehCenter). La scelta dell'Adaleh Center venne duramente critica dal ricorrente,vista l'assoluta mancanza di esperienza pratica del personale in materia dimonitoraggio, le modeste dimensioni del Centro (ed il conseguente timoreche non sarebbe stato capace di imporsi sulle autorità giordane), la sua scarsaquantità di pubblicazioni critiche del governo (una), ed i legami familiari tra ilcapo del Centro e membri della GID.Il MOU stabilisce: «1. If arrested, detained or imprisoned followinghis return, a returned person will be afforded adequate accommodation,nourishment, and medical treatment and will be treated in a humane andproper manner, in accordance with internationally accepted standards.2. A returned person who is arrested or detained will be brought promptlybefore a judge or other officer authorised by law to exercise judicial power inorder that the lawfulness of his detention may be decided.3. A returned person who is arrested or detained will be informed promptlyby the authorities of the receiving state of the reasons for his arrest or detention,and of any charge against him.4. If the returned person is arrested, detained or imprisoned within 3 years ofthe date of his return, he will be entitled to contact, and then have promptand regular visits from the representative of an independent body nominatedjointly by the UK and Jordanian authorities.
