<strong>Corruption</strong> <strong>in</strong> the M<strong>in</strong><strong>in</strong>g Sector: Prelim<strong>in</strong>ary Overview 379<br />

The three major areas of corruption risk <strong>in</strong> the <strong>Ethiopia</strong>n m<strong>in</strong><strong>in</strong>g sector<br />

have been analyzed and mapped:<br />

License issu<strong>in</strong>g. Licens<strong>in</strong>g authority officials may extort or be offered<br />

bribes by m<strong>in</strong><strong>in</strong>g companies <strong>in</strong> return for issu<strong>in</strong>g licenses, for issu<strong>in</strong>g<br />

licenses more quickly, or for specify<strong>in</strong>g less-onerous license conditions.<br />

License operation. M<strong>in</strong><strong>in</strong>g companies may deliberately breach m<strong>in</strong><strong>in</strong>g<br />

conditions (for example, environmental, health, and safety regulations,<br />

as well as the extent or area of m<strong>in</strong><strong>in</strong>g permitted).<br />

M<strong>in</strong><strong>in</strong>g revenue. M<strong>in</strong><strong>in</strong>g companies may deliberately understate output<br />

and profit and overstate costs to reduce royalties and profit taxes.<br />

If the license operation and m<strong>in</strong><strong>in</strong>g revenue breaches are discovered,<br />

the m<strong>in</strong><strong>in</strong>g company may also bribe <strong>in</strong>spectors to overlook the breaches.<br />

In addition, there are corruption risks <strong>in</strong> relation to<br />

The <strong>in</strong>terface between m<strong>in</strong><strong>in</strong>g companies and local <strong>in</strong>habitants (for<br />

example, theft of compensation payments by local officials or illegal<br />

m<strong>in</strong><strong>in</strong>g by local <strong>in</strong>habitants <strong>in</strong> a m<strong>in</strong><strong>in</strong>g company’s license area)<br />

The contractors and suppliers to the m<strong>in</strong><strong>in</strong>g operation<br />

Falsification of the quality of the product<br />

Theft of the product.<br />

In general, some effective anticorruption measures govern the <strong>Ethiopia</strong>n<br />

m<strong>in</strong><strong>in</strong>g sector. The laws and regulations as well as the documentation and<br />

processes for issu<strong>in</strong>g and operat<strong>in</strong>g licenses are clear and simple, therefore<br />

m<strong>in</strong>imiz<strong>in</strong>g the complexity <strong>in</strong> procedure and discretion of officials that<br />

can facilitate corruption. There are some committed and well-qualified<br />

licens<strong>in</strong>g officials and <strong>in</strong>spectors. A new computer database is be<strong>in</strong>g<br />

developed to improve access to license <strong>in</strong>formation, and the <strong>Ethiopia</strong>n<br />

government is implement<strong>in</strong>g bus<strong>in</strong>ess process reeng<strong>in</strong>eer<strong>in</strong>g (BPR) to<br />

speed up the license issu<strong>in</strong>g process. These all play an important part <strong>in</strong><br />

reduc<strong>in</strong>g the risk of corruption.<br />

However, further steps are recommended to enhance exist<strong>in</strong>g anticorruption<br />

controls, particularly regard<strong>in</strong>g the licens<strong>in</strong>g and regulation processes.<br />

A key problem lies <strong>in</strong> the shortage of well-tra<strong>in</strong>ed licens<strong>in</strong>g<br />

authority staff. In license issu<strong>in</strong>g, there is a shortage of officials to deal<br />

with the <strong>in</strong>creas<strong>in</strong>g number of license applications and the complex<br />

issues that arise <strong>in</strong> relation to license conditions. In license operation and<br />

revenue calculation, there are too few <strong>in</strong>spectors and auditors to <strong>in</strong>spect
