decorative dimension stones, and gemstones. These exports contribute<br />

7–10 percent of <strong>Ethiopia</strong>’s total export foreign currency earn<strong>in</strong>gs.<br />

As of 2010, 13 licens<strong>in</strong>g authorities (one federal, n<strong>in</strong>e regional, and<br />

three city) were responsible for issu<strong>in</strong>g prospect<strong>in</strong>g, exploration, and m<strong>in</strong><strong>in</strong>g<br />

licenses. They are also responsible for <strong>in</strong>spect<strong>in</strong>g licensed m<strong>in</strong>es to<br />

ensure that the companies are comply<strong>in</strong>g with license conditions and that<br />

all m<strong>in</strong><strong>in</strong>g revenues are be<strong>in</strong>g paid.<br />

The sector is undergo<strong>in</strong>g a rapid expansion. In 1998, only three<br />

exploration licenses and one m<strong>in</strong><strong>in</strong>g license were issued. By early 2009,<br />

however, the federal M<strong>in</strong>istry of M<strong>in</strong>es and Energy 2 had issued 160<br />

licenses 3 <strong>in</strong>volv<strong>in</strong>g 99 foreign companies, 50 jo<strong>in</strong>t ventures (of foreign<br />

and <strong>Ethiopia</strong>n companies), and 11 <strong>Ethiopia</strong>n companies. Just over a<br />

year later, <strong>in</strong> April 2010, another six exploration and two m<strong>in</strong><strong>in</strong>g<br />

licenses had been issued. This growth means that the amount of money<br />

at stake <strong>in</strong> the sector will <strong>in</strong>crease and, with it, the corruption risk <strong>in</strong><br />

monetary terms. In addition, the government will need to significantly<br />

<strong>in</strong>crease resources to manage this growth. Inadequate management, <strong>in</strong><br />

terms of both number of staff and ability of staff, can lead to <strong>in</strong>creased<br />

corruption.<br />

The Legislative and Institutional Framework for M<strong>in</strong><strong>in</strong>g<br />

<strong>in</strong> <strong>Ethiopia</strong><br />

Legislative Framework<br />

The <strong>Ethiopia</strong>n m<strong>in</strong><strong>in</strong>g sector has a well-def<strong>in</strong>ed process for controll<strong>in</strong>g<br />

m<strong>in</strong>e licens<strong>in</strong>g and operations. Detailed m<strong>in</strong><strong>in</strong>g laws and regulations govern<br />

license issu<strong>in</strong>g, license conditions, m<strong>in</strong><strong>in</strong>g operations, m<strong>in</strong><strong>in</strong>g revenues,<br />

and the functions of the licens<strong>in</strong>g authorities, as follows: 4<br />

License issu<strong>in</strong>g. Under <strong>Ethiopia</strong>n law, a license is required to prospect,<br />

explore, or m<strong>in</strong>e <strong>in</strong> <strong>Ethiopia</strong> (although <strong>Ethiopia</strong>n nationals do not<br />

need prospect<strong>in</strong>g licenses). The license types <strong>in</strong>clude discovery certificates,<br />

prospect<strong>in</strong>g licenses, exploration licenses, and m<strong>in</strong><strong>in</strong>g<br />

licenses. There are three types of m<strong>in</strong><strong>in</strong>g license: artisanal, smallscale,<br />

and large scale. People who satisfy the license requirements<br />

have the right to acquire a license provided they are suitably qualified<br />

and possess the required f<strong>in</strong>ancial resources, technical competence,<br />

and professional skill and experience necessary to fulfill the<br />

license obligations.
