<strong>Corruption</strong> <strong>in</strong> the M<strong>in</strong><strong>in</strong>g Sector: Prelim<strong>in</strong>ary Overview 387<br />

companies comply with laws, regulations, and license conditions; and<br />

monitor<strong>in</strong>g output and profit to ensure that the correct amounts of royalty<br />

and tax are paid. The authorities’ respective responsibilities break<br />

down as follows:<br />

Federal licens<strong>in</strong>g authority. MOM acts as the federal licens<strong>in</strong>g authority,<br />

with responsibility for large-scale m<strong>in</strong><strong>in</strong>g by domestic <strong>in</strong>vestors and all<br />

operations by foreign <strong>in</strong>vestors<br />

Regional and city licens<strong>in</strong>g authorities. The relevant regional or city<br />

licens<strong>in</strong>g authorities act as the licens<strong>in</strong>g authorities <strong>in</strong> their respective<br />

areas for artisanal m<strong>in</strong><strong>in</strong>g, prospect<strong>in</strong>g, exploration, small-scale m<strong>in</strong><strong>in</strong>g,<br />

and small- and large-scale m<strong>in</strong><strong>in</strong>g of construction m<strong>in</strong>erals, provided<br />

that only domestic <strong>in</strong>vestors are undertak<strong>in</strong>g these activities.<br />

In view of the division of responsibility among licens<strong>in</strong>g authorities,<br />

the licens<strong>in</strong>g process often requires liaison between authorities to determ<strong>in</strong>e<br />

whether licenses have already been issued <strong>in</strong> a particular area. This<br />

territorial overlap can result <strong>in</strong> delay and uncerta<strong>in</strong>ty.<br />

To assist the licens<strong>in</strong>g process, MOM operates a computer database<br />

that shows the status of federal licenses (for example, type of license,<br />

identity of license holder, nationality of license holder, location of license,<br />

type of m<strong>in</strong>eral) and the location of federal licenses on a map. Most<br />

regional and city licens<strong>in</strong>g authorities currently hold data <strong>in</strong> paper-based<br />

systems or separate computer systems. The <strong>Ethiopia</strong>n government is currently<br />

develop<strong>in</strong>g a new computer database that will show all federal,<br />

regional, and city licenses <strong>in</strong> the m<strong>in</strong><strong>in</strong>g sector. This consolidated system<br />

will enable applicants for new licenses (federal, regional, or city) to f<strong>in</strong>d<br />

out immediately whether the areas that <strong>in</strong>terest them are available and,<br />

if so, to obta<strong>in</strong> immediate priority.<br />

The <strong>Ethiopia</strong>n government is also currently implement<strong>in</strong>g BPR <strong>in</strong> relation<br />

to the m<strong>in</strong><strong>in</strong>g sector, affect<strong>in</strong>g MOM and regional and city licens<strong>in</strong>g<br />

authorities. One objective of the BPR is to shorten significantly the time<br />

frame for issu<strong>in</strong>g licenses. In particular, the BPR aims to issue exploration<br />

licenses with<strong>in</strong> two days after application submission and to issue m<strong>in</strong><strong>in</strong>g<br />

licenses with<strong>in</strong> 19 days after application submission.<br />

Figure 9.1 illustrates the licens<strong>in</strong>g process, from prospect<strong>in</strong>g to issue of<br />

a m<strong>in</strong><strong>in</strong>g license. An <strong>Ethiopia</strong>n national can reserve rights over discovered<br />

m<strong>in</strong>erals by way of a discovery certificate, which <strong>in</strong> turn provides the<br />

right to apply for an exploration license, which <strong>in</strong> turn provides the right<br />

to apply for a m<strong>in</strong><strong>in</strong>g license (if, <strong>in</strong> each case, the national satisfies the
