THIS AGREEMENT made the day of July, 2012
BETWEEN:
JEFFREY GORDON GRANT AND GWEN FRANCES GRANT
(hereinafter called the “Owner”)
- and –
OF THE FIRST PART
THE CORPORATION OF THE MUNICIPALITY OF LAMBTON SHORES
(hereinafter called the “Municipality”)
OF THE SECOND PART
WHEREAS the Owner has requested permission for a recreational vehicle to be placed
on the lands and be occupied as the Owner’s residence while a new dwelling is being
constructed on the lands located at 8529 Vance Drive and described as Part of Block
A, Registered Plan 691 (Bosanquet), Municipality of Lambton Shores.
AND WHEREAS the subject lands are zoned Residential - 6 (R6) in Zoning By-law 1 of
2003 and human occupancy of a recreational vehicle is not permitted in a Residential -
6 (R6) Zone and would require special permission from Council;
AND WHEREAS the Council for the Municipality of Lambton Shores has agreed to the
request to allow a recreational vehicle to be placed on the property and be occupied as
a residence by the Owner on a temporary basis, on the condition that an agreement
outlining the terms and conditions of the approval is executed with the Owner of the
lands;
NOW THEREFORE THIS AGREEMENT WITNESSETH that for and in consideration of
the mutual covenants hereinafter set forth, the Parties hereto agree as follows:
The Municipality hereby agrees that a recreational vehicle may be placed on the
property and be occupied as a residence by the owner on a temporary basis, while a
new dwelling is being constructed on the lands subject to the following conditions:
1. The Owners agree that occupancy of the recreational vehicle will cease by
November 30, 2012;
2. That should the Owners not cease occupancy of the recreational vehicle by
November 30, 2012, the Municipality shall pursue legal action against the
Owners the cost of which shall be borne by the Owner and their successors in
