THE MUNICIPALITY OF LAMBTON SHORES TR Report No. 47-2012 Friday, July 6, 2012 TO: FROM: RE: Mayor Weber and Members of Council Janet Ferguson, Treasurer Proposed Greenhouse Construction RECOMMENDATION: That Council directs staff to report back on all of the issues surrounding the proposed construction of a greenhouse within Lambton Shores as outlined in Treasurers report TR- 47-2012. REPORT There have been discussions in the community and requests of staff to determine costs associated with the construction of a greenhouse in Lambton Shores. There are many variables for this type of development and we would like to make sure that the proper treatment is applied keeping in mind the best interest of Lambton Shores and the surrounding infrastructure now and in the future. We are in receipt of a letter suggesting that the proposed construction is exempt from the Development Charges By-law (DC) and they have requested a letter of confirmation to that effect. The letter cites that this project falls under the “bonafide farm use” exemption. At present we have not issued any response as we would like to confirm the intent of the by-law with respect to greenhouses and how it applies to the overall proposed project as well as the other issues that surround this type of construction such as water servicing and in general the impact to the infrastructure of Lambton Shores. We have engaged conversations with Gary Scandlan of Watson and Associates; who was consulted to prepare our background study, to review the treatment of the DC bylaw as it applies to the applicable greenhouse charge. We would like to continue to explore this expertise as well as how other municipalities have dealt with a similar project. Preliminary information has indicated that if Council wishes to have a lesser or even $0.00 greenhouse DC fee, we must follow the DC Act and perform the prescribed public meeting process and pass a new by-law. As you know our by-law does expire at the end of 2012 and a new study is being proposed and this item could be considered at that time. If there is an urgent need to have a decision; an interim measure could be to have a delayed payment agreement; thereby the property owner signing the agreement agreeing to pay the charge in the future whatever that may be. 249
The Community Services Department has received a request to provide a cost for a water service and are currently preparing the information. Depending on the DC application there may be a need to determine the correct application of By-law 46-2008 which relates to the water connection fee and By-law 81-2009 which relates to the rural water expansion project. Respecting the fact that this project is a cross of the Building, Planning (zoning), Clerk, Treasury and Community Services Departments, and also that this is a first for Lambton Shores, staff would like time to ensure that we have all of the information for this project and applicable legislations are complied with and applied properly for now and the future.
