affiliate with respect to its self funded employee welfare benefit plan<br />

authority to reduce recovery amounts by as much as twenty five percent 25 ofthe<br />
total amount of benefits paid on Employer s behalf and to en1ter into binding settlement<br />

In the event a settlement offer represents a reduction greater than the percentage<br />
identified above Connecticut General and its subcontractors should seek settlement<br />

All amounts reimbursed to Employer s benefit payment account shall be refunded at the<br />
gross amount Connecticut General s and its subcontractors subrogation administration<br />
fee on cases where Connecticut General and its subcontractors have retained counsel and<br />
in cases where no counsel has been retained by Connecticut General and its<br />
subcontractors are both reflected in the Schedule of Financial Charges<br />
For the purposes<br />
of such fee calculations the use ofcounsel to perform minist rial acts such as filing of<br />
appearances or defenses in states which require plaintiffs to name employee benefit plans<br />
as party defendants and in similar circumstances shall not constitute the retention of<br />
counsel<br />
