Administrative Services Only Agreement<br />
C<br />
Except where agreed to by Connecticut General and Employer Conm cticut General and its<br />
subcontractors shaH have no duty or obligation to represent Employer in any litigation or court<br />
proceeding involving any matter which is the subject ofthis Agreement but shaH make available<br />
to Employer and or Employer s counsel such information relevant to such action or<br />
proceeding as<br />
Connecticut General and its subcontractors may have as a result ofits handling of any matter<br />
under this Agreement<br />
D<br />
In the event Employer purchases individual or<br />
aggregate stop loss coverage from Connecticut<br />
General or an affiliate with respect to its self funded employee welfare benefit plan at any time<br />
during the lifeofthis Agreement the provisions of paragraph II below shaH control<br />
II<br />
Plans with Connecticut General Stop Loss Coveraee<br />
If Employer has purchased individual or aggregate stop loss coverage from Connecticut General or an<br />
affiliate with respect to its self funded employee welfare benefit plan<br />
A<br />
Connecticut General and its subcontractors shaH have the right and responsibility to manage aH<br />
conditional claim payment and or subrogation recoveries under the Pllm<br />
Connecticut General<br />
and its subcontractors shaH reimburse to the Plan the recovery<br />
minus relevant individual and<br />
aggregate stop loss payments made by Connecticut General<br />
B<br />
All amounts reimbursed to Employer s benefit payment account shall be refunded at the gross<br />
amount Connecticut General s and its subcontractors subrogation administration fee on cases<br />
where Connecticut General and its subcontractors have retained counsel and in cases where no<br />
counsel has been retained by Connecticut General and its subcontractors are both reflected in the<br />
Schedule of Financial Charges<br />
C<br />
Connecticut General and its subcontractors shaH have no<br />
