(2) shall maintain records and provide the reports required under AS 46.03.465(a);<br />

(3) shall collect and test samples as required under AS 46.03.465 (b) and (d) and provide the<br />

reports with respect to those samples required by AS 46.03.475 (c);<br />

(4) shall report discharges in accordance with AS 46.03.475 (a);<br />

(5) shall allow the department access to the vessel at the time samples are taken under AS<br />

46.03.465 for purposes of taking the samples or for purposes of verifying the integrity of the sampling<br />

process; and<br />

(6) shall submit records, notices, and reports to the department in accordance with AS<br />

46.03.475 (b), (d), and (e).<br />

AS 462.463 (a&e) Prohibited discharges; limitations on discharges.<br />

(a) Except as provided in (h) of this section, a person may not discharge untreated sewage from a<br />

commercial passenger vessel into the marine waters of the state.<br />

(e) An owner or operator may not discharge any treated sewage, graywater, or other wastewater<br />

from a large commercial passenger vessel into the marine waters of the state unless the owner or<br />

operator obtains a permit under AS 46.03.100 and 46.03.462, and provided that the vessel is not in an<br />

area where the discharge of treated sewage, graywater, or other wastewaters is otherwise prohibited.<br />

<strong>Alaska</strong> GP 1.1 Eligibility<br />

Large commercial passenger vessels that operate in marine waters of the state are eligible to seek<br />

coverage under this general permit (AS 46.03.462). The scope of the permit does not include waters<br />

of Glacier Bay National Park and Preserve.<br />

<strong>Alaska</strong> GP 1.3 Discharge Restrictions<br />

1.3.1 Discharges to water bodies included in the ADEC CWA Section 305(b) report or effective CWA<br />

Section 303(d) list of waters which are “impaired” or “water quality-limited” are prohibited if the<br />

“impaired” or “water quality-limited” designation is due to any of the pollutant parameters for<br />

which effluent limits are included in applicable Effluent Limit and Discharge Reporting Tables (Table<br />

1 through Table 7 of section 1.5).<br />

1.3.2 There shall be no discharge of foam (in other than trace amounts), oily wastes (which produce<br />

a sheen on the surface of the receiving waters), floating solids, garbage or grease into marine<br />

waters of the state.<br />

1.3.3 Sediment and sludge that accumulates in tanks shall not be disposed of by discharging into<br />

marine waters of the state unless it complies with the treatment and effluent requirements for<br />

sewage and graywater.<br />

1.3.4 All sewage and graywater must be treated prior to discharge into marine waters of the state<br />

by an advanced wastewater treatment system to produce an effluent quality that complies with the<br />

applicable limits in Table 1 through Table 7 of section 1.5.<br />

1.3.5 The discharge volume and flow rate shall not exceed the design capacity of the advanced<br />

wastewater treatment system.<br />

No person shall discharge any untreated sewage from a cruise vessel into the applicable waters of <strong>Alaska</strong>.<br />

33 CFR 159.309 (a)<br />

(a) No person shall discharge treated sewage or graywater from a cruise vessel into the applicable waters of <strong>Alaska</strong><br />

unless:<br />

(1) The cruise vessel is underway and proceeding at a speed of not less than six knots;<br />

(2) The cruise vessel is not less than one nautical mile from the nearest shore, except in areas designated by the<br />

Coast Guard in consultation with the State of <strong>Alaska</strong>;<br />
