Reduced-Pressure Principle Backflow Prevention Assembly, adopted by reference in 18 AAC 80.010(b).<br />

The owner of the public water system may delegate the installation, maintenance, and testing of the<br />

backflow prevention device to the operator of the facility that poses the risk. This delegation does not<br />

relieve the owner of the public water system of the responsibility to install, maintain, and test the<br />

backflow prevention device.<br />

21 CFR <strong>12</strong>40.86 Protection of pier water system.<br />

No vessel engaged in interstate traffic shall make a connection between its nonpotable water system<br />

and any pier potable water system unless provisions are made to prevent backflow from the vessel to<br />

the pier.<br />

Text: Shellfish tags are maintained for non-frozen shellfish. (21 CFR <strong>12</strong>40.60)<br />

Background: Many molluscan shellfish such as clams, oysters, and scallops are filter feeders, they gather<br />

food by filtering water to eat small plankton. While feeding in this manner it is possible that they could<br />

ingest communicable diseases from human sewage or animal wastes. Even small amounts of bacteria<br />

could multiply if not handled properly, such as inadequately cooling.<br />

What to check for: Note- this does not apply to frozen or canned shellfish, only fresh. It also does not<br />

apply to crustacean shellfish such as crabs or shrimp. Check that fresh molluscan shellfish such as<br />

oysters are tagged or labeled and handled and stored in a sanitary manner.<br />

(a) A person shall not offer for transportation, or transport, in interstate traffic any molluscan shellfish<br />

handled or stored in such an insanitary manner, or grown in an area so contaminated, as to render such<br />

molluscan shellfish likely to become agents in, and their transportation likely to contribute to the spread<br />

of communicable disease from one State or possession to another.<br />

(b) All shellstock shall bear a tag that discloses the date and place they were harvested (by State and<br />

site), type and quantity of shellfish, and by whom they were harvested (i.e., the identification number<br />

assigned to the harvester by the shellfish control authority, where applicable or, if such identification<br />

numbers are not assigned, the name of the harvester or the name or registration number of the<br />

harvester's vessel). In place of the tag, bulk shellstock shipments may be accompanied by a bill of lading<br />

or similar shipping document that contains the same information.<br />

(c) All containers of shucked molluscan shellfish shall bear a label that identifies the name, address,<br />

and certification number of the packer or repacker of the molluscan shellfish.<br />

(d) Any molluscan shellfish without such a tag, shipping document, or label, or with a tag, shipping<br />

document, or label that does not bear all the information required by paragraphs (b) and (c) of this<br />

section, shall be subject to seizure or refusal of entry, and destruction.<br />
