(1) the waste has been treated and disposed of in a manner that uses the maximum degree of<br />

reduction of the harmful qualities of a hazardous waste that is subject to this chapter and that the<br />

department, on a case-by-case basis, determines is achievable for the hazardous waste by application of<br />

production processes and available methods, systems, and techniques, taking into account energy,<br />

environmental, and economic impacts and other costs; and<br />

(2) the waste is disposed of in a manner that will ensure the protection of human health, livestock,<br />

wildlife, property, and the environment.<br />

(b) The department shall adopt regulations in accordance with AS 44.62 (Administrative Procedure<br />

Act) for the treatment, storage, and disposal of hazardous wastes to ensure the protection of human<br />

health, livestock, wildlife, property, and the environment.<br />

AS 46.03.710. Pollution prohibited.<br />

A person may not pollute or add to the pollution of the air, land, subsurface land, or water of the state.<br />

AS 46.03.745. Hazardous substance release.<br />

Except for a controlled release, the reporting of which is the subject of an agreement with the<br />

commissioner under AS 46.09.010 (b), a person may not cause or permit the release of a hazardous<br />

substance as defined in AS 46.09.900.<br />

Statute Definitions (46.03.900):<br />

(9) "hazardous waste" means a waste or combination of wastes that because of quantity, concentration,<br />

or physical, chemical, or infectious characteristics may<br />

(A) cause, or significantly contribute to, an increase in mortality or an increase in serious<br />

irreversible or incapacitating reversible illness; or<br />

(B) pose a substantial present or potential hazard to human health or the environment when<br />

improperly managed, treated, stored, transported, or disposed of;<br />

(20) "pollution" means the contamination or altering of waters, land, or subsurface land of the state in a<br />

manner which creates a nuisance or makes waters, land, or subsurface land unclean, or noxious, or<br />

impure, or unfit so that they are actually or potentially harmful or detrimental or injurious to public<br />

health, safety, or welfare, to domestic, commercial, industrial, or recreational use, or to livestock, wild<br />

animals, bird, fish, or other aquatic life;<br />

18 AAC 69.040. Hazardous waste and hazardous substance offloading plan.<br />

(a) As part of the plan required under AS 46.03.475(e)(2), that describes a vessel's policies and<br />

procedures for offloading of hazardous waste or a hazardous substance from a vessel while that vessel is<br />

operating in the marine waters of the state, and to the extent that the offloading is not covered by a<br />

report or notice submitted under AS 46.03.475(d), the owner or operator shall include, for each vessel<br />

that the owner or operator intends to operate, or cause or allow to operate, and for each hazardous<br />

waste or hazardous substance anticipated to be offloaded,<br />

(1) an estimate of the volume and type of each waste or substance;<br />

(2) the proposed offloading method;<br />

(3) material safety information provided by the manufacturer, if applicable;<br />
