3.3 Department for Transport<br />
The <strong>Radioactive</strong> Materials Transport Division of the Department for Transport (DfT) is the<br />
competent body in the <strong>UK</strong> for approving packages for the transport of radioactive material. The<br />
regulation of transport packages is based on international standards and recommendations from<br />
the International Atomic Energy Agency (IAEA) in particular the IAEA Transport Regulations.<br />
The transport of nuclear materials is regulated under The Carriage of Dangerous Goods and<br />
Use of Transportable Pressure Equipment Regulations (2007) [Ref.9]. These regulations<br />
transpose the Commission Directive 2006/89/EC on transport of dangerous goods by road and<br />
2006/90/EC on the transport of dangerous goods by rail. These directives require that the ADR<br />
(the European Agreement concerning the international carriage of dangerous goods by road)<br />
and the RID (the european agreement concerning international carriage of dangerous goods by<br />
rail) are implemented in member states.<br />
3.4 Health and Safety Executive Safe Management of <strong>Radioactive</strong> <strong>Waste</strong> on <strong>UK</strong><br />
Nuclear Sites<br />
The Health and Safety Executive (HSE) regulate the operators of nuclear establishments<br />
through a nuclear site licence granted under the Nuclear Installations Act 1965 (as amended).<br />
A nuclear site licence has 36 Licence Conditions, with which the licensee (the operator) is<br />
required to demonstrate compliance. These Licence Conditions cover the safety aspects of<br />
design, manufacture, construction, commissioning, operation, maintenance and<br />
decommissioning of the installation and the management of radioactive waste on site.<br />
Whilst virtually all of the Licence Conditions are relevant in some respect to operations involving<br />
radioactive waste, a smaller number have been framed specifically to regulate the aspects of<br />
the management of radioactive waste that fall within the remit of HSE. Those conditions that<br />
specifically relate to the management of waste are listed and described below. These have<br />
been taken into account in the design and planned operation of the <strong>EPR</strong> for when a proposed<br />
operator applies for a nuclear site licence.<br />
3.4.1 Licence Condition 32 Accumulation of <strong>Radioactive</strong> <strong>Waste</strong><br />
Licence Condition 32 states that:<br />
1. The licensee shall make and implement adequate arrangements for minimising so far as<br />
is reasonably practicable the rate of production and total quantity of radioactive waste<br />
accumulated on the site at any time and for recording the waste so accumulated.<br />
2. The licensee shall submit to the Executive for approval such part or parts of the<br />
aforesaid arrangements as the Executive may specify.<br />
3. The licensee shall ensure that once approved no alteration or amendment is made to the<br />
approved arrangements unless the Executive has approved such alteration or<br />
amendment.<br />
4. Without prejudice to paragraph (1) of this condition the licensee shall ensure that<br />
radioactive waste accumulated or stored on the site complies with such limitations as to<br />
quantity, type and form as may be specified by the Executive.
