5. The licensee shall, if so specified by the Executive, not accumulate radioactive waste<br />
except in a place and in a manner approved by the Executive.<br />
This Licence Condition requires the licensee to make and implement adequate arrangements<br />
for minimising so far as is reasonably practicable the rate of production and total quantity of<br />
radioactive waste accumulated on the site at any time and for maintaining records of<br />
accumulated waste. The underlying purpose of the Licence Condition is to ensure that<br />
licensees have regard to the total quantities of waste that accumulate on a site and that where<br />
required the form of the waste is such that it is passively safe 1 .<br />
3.4.2 Licence Condition 33 Disposal of <strong>Radioactive</strong> <strong>Waste</strong><br />
Licence Condition 33 requires that:<br />
The licensee shall, if so directed by the Executive, ensure that radioactive waste accumulated or<br />
stored on the site is disposed of as the Executive may specify and in accordance with an<br />
authorisation granted under the <strong>Radioactive</strong> Substances Act 1960 (RSA 60) or, as the case may<br />
be, the <strong>Radioactive</strong> Substances Act 1993 (RSA 93; Ref. 10).<br />
The majority of Certificates of Authorisation are now granted under RSA93. Any New Nuclear<br />
Power Station will apply for an authorisation under RSA93.<br />
This Licence Condition provides the HSE with power to direct a licensee to dispose of waste. In<br />
practice this power is rarely used.<br />
3.4.3 Licence Condition 34 Leakage and Escape of <strong>Radioactive</strong> Material and<br />
<strong>Radioactive</strong> <strong>Waste</strong><br />
Licence Condition 34 states that:<br />
1. The licensee shall ensure, so far as is reasonably practicable, that radioactive material<br />
and radioactive waste on the site is at all times adequately controlled or contained so<br />
that it cannot leak or otherwise escape from such control or containment.<br />
2. Notwithstanding paragraph (1) of this condition the licensee shall ensure, so far as is<br />
reasonably practicable, that no such leak or escape of radioactive material or radioactive<br />
waste can occur without being detected, and that any such leak or escape is then<br />
notified, recorded, investigated and reported in accordance with arrangements made<br />
under condition 7.<br />
3. Nothing in this condition shall apply to discharges or releases of radioactive waste in<br />
accordance with an approved operating rule or with disposal authorizations granted<br />
under RSA60 or, as the case may be, RSA93.<br />
