Making surepublic transport is accessible and contracted transport is effective are hugechallenges <strong>for</strong> local authorities. Checklists C10 and C11 in Appendix 6 givean overview of how transport needs to be part of planning <strong>for</strong> disabledyoung people.Key legislation, guidance and resourcesThe Education Act 1996 makes clear that when deciding whattransport support by way of both services and financial support tooffer, the local authority must specify what transport arrangements canbe made available <strong>for</strong> disabled young people.Education and Inspections Act 2006 introduces new duties on localeducation authorities to provide free transport <strong>for</strong> eligible children,including those with disabilities. These come into <strong>for</strong>ce in 2008.The Disability Discrimination Act 1995 now covers certain types ofland based transport. The Disability Rights Commission (DRC) hasproduced a Code of Practice on the provision and use of transportvehicles. It outlines the duties under Part 3 of the DisabilityDiscrimination Act 1995, as amended by the Disability DiscriminationAct 2005, and supporting Regulations. These new duties came into<strong>for</strong>ce in December 2006.Learning and Skills Act 2000 states that the LSC may providefinancial assistance to help with transport costs (section 5). Inexercising its powers to provide financial resources, the LSC must ‘haveregard to the needs of persons with disabilities and/or learningdifficulties’ (Section 13).Transport Support Arrangements <strong>for</strong> Students aged 16–19,2006/07. Guidance circular <strong>for</strong> Local Authority led partnershipsincluding further education and sixth <strong>for</strong>ms when drawing up home toschool/college transport policies. This circular provides an update ofrequirements and clarifies duties under the Education Act 1996(schedule 19 Education Act 2002).States that:‘It is not acceptable <strong>for</strong> partners to deny responsibility <strong>for</strong> students and topass the ‘problem’ between one another.Chapter 3: Participation and further supportTransport69
