The City has adopted an ordinance to fund parks and recreation in accordancewith Section 66477 of the Subdivision Map Act (the Quimby Act). The City’s QuimbyOrdinance allows the City to require the payment of a fee or the dedication of an equivalentarea of parkland when new residential subdivisions are proposed. The law states that “thededication of land or the payment of fees, or both, shall not exceed the proportionate amountnecessary to provide three acres of park area per 1,000 persons residing within a subdivisionsubject to this section, unless the amount of existing neighborhood and community park area,as calculated pursuant to this subdivision, exceeds that limit, in which case the legislative bodymay adopt the calculated amount as a higher standard not to exceed five acres per 1,000 personsresiding in a subdivision subject to this section.” In addition to Quimby fees, facilities can beprovided by grants, donations, user fees, community fund raising events, joint ventures, andjoint use agreements.State Public Park Preservation Act. The State Public Park Preservation Act was adopted topreserve and protect public parks. Under the public resource code, cities may not acquire anyreal property that is in use as a public park for any non-park use unless compensation and/orland are provided to replace the parkland acquired.The 2005 General Plan includes policies directing land acquisition for park areas where futurepopulation growth and higher density is anticipated, and encourages a balanced park systemthat is accessible to all.Policy 6AAction 6.1:Expand the park and trail network to link shoreline, hillside, andwatershed areas.Develop new neighborhood parks, pocket parks, and community gardensas feasible and appropriate to meet citizen needs, and require them innew development.4.13-9City of Ventura
