Schedule 2 – Page 3<strong>November</strong> 5, <strong>2012</strong>172 Niska Road1 Storey portion and 2.4m from the Side Lot Line to the wall <strong>of</strong> the 1.5to 2 Storey portion.5.1.2.11 Where Lots have less than 12 metres <strong>of</strong> Frontage, the Garage islimited to a maximum <strong>of</strong> 55% <strong>of</strong> the Lot width (as measured at theFront Yard Setback).PROPOSED CONSENT CONDITIONS:The following conditions are provided as information to <strong>Council</strong> and will be imposedat the time consent applications are considered by the Committee <strong>of</strong> Adjustment tocreate two severed lots and one retained lot:1. Prior to the issuance <strong>of</strong> building permits, the Owner shall provide the <strong>City</strong>with written confirmation that the dwellings on the subject site will beconstructed to a standard that implements energy efficiency in order tosupport the Community Energy Initiative to the satisfaction <strong>of</strong> the GeneralManager <strong>of</strong> Planning Services in accordance with the letter attached asAttachment 7 to Report 12-100 from Planning and Building, Engineering andEnvironment dated <strong>November</strong> 4, <strong>2012</strong>.2. The Owner shall be responsible for the payment <strong>of</strong> cash-in-lieu <strong>of</strong> parklanddedication in accordance with the <strong>City</strong> <strong>of</strong> <strong>Guelph</strong> By-law (1989)-13410, asamended by By-law (1990)-13545 and By-Law (2007)-18225,or anysuccessor there<strong>of</strong> prior to the issuance <strong>of</strong> building permits.3. The Developer will be required to pay the proportionate share <strong>of</strong> the actualcosts <strong>of</strong> the existing roadworks and existing municipal services and anystreet lighting upgrades on Niska Road across the entire frontage <strong>of</strong> 172Niska Road as determined by the General Manager/<strong>City</strong> Engineer, prior toany severance and prior to any construction and grading <strong>of</strong> the lands.4. Prior to any severance and prior to any construction and grading <strong>of</strong> thelands, the Developer shall provide a complete “sightline/vertical curveassessment” report prepared by a pr<strong>of</strong>essional engineer to determinewhether sightline distances are sufficient for the proposed driveways.5. Prior to any severance and prior to any construction and grading <strong>of</strong> thelands, the Developer shall be responsible for all <strong>of</strong> the costs associated withthe demolition and removal <strong>of</strong> the existing dwelling from the property.6. That prior to any severance and prior to any construction and grading <strong>of</strong> thelands, the Developer will be responsible to decommission the existing septicsystem and private well to the satisfaction <strong>of</strong> the <strong>City</strong>’s Plumbing/SewageSystem Inspector.7. Prior to any severance and prior to any construction and grading <strong>of</strong> thelands, the Developer shall pay all <strong>of</strong> the costs associated with any removal <strong>of</strong>existing cedar trees on the road allowance that are located along the entirefrontage <strong>of</strong> 172 Niska Road, to the satisfaction <strong>of</strong> the General Manager/<strong>City</strong>Engineer.
