(4) (ii) No extension of deputation of any Government servant shall be sanctioned for the fourthyear. However, the Government may, in exceptional and special circumstances in public interest,sanction the extension of deputation for the fourth year in respect of any Government servant.(4) (iii) In case the Government require the services of Government servants in the middle of threeyears period for administrative reason the competent authority may revert them to their parentdepartment.[G.O. A transfer to foreign service shall not be admissible unless—(a) the duties to be performed after the transfer are such as should, for public reasons,be rendered by a Government servant, and(b) the Government servant transferred holds, at the time of transfer, a post paid fromthe Consolidated Fund of the State.Explanation.—The loan of a Government servant to a private undertaking shall be regarded as avery exceptional measures requiring special justification on a rigorous application of the principleenunciated in clause (a) of this rule.RULINGS.Government Servants on Probation.(1) The transfer to foreign service from the date on which an individual is appointed to a post underGovernment on probation is permissible.(The Comptroller and Auditor-General No.T.1191-A-204/26, dated 22nd August 1924.)(2) No Government servant shall ordinarily be permitted to take up private employmentconcurrently with leave preparatory to retirement. If such a Government servant is keen ontaking up private employment before he attains the age of superannuation his services shallordinarily be placed at the disposal of the private employer on the usual foreign service termsafter cancelling the unexpired portion of the leave preparatory to retirement. The balance ofleave preparatory to retirement not availed of in order to take up private employment shall notbe treated as constructive refusal of leave for purposes of Fundamental Rule 86 (or rule 7 ofthe Tamil Nadu Leave Rules, 1933). The terms of foreign service shall not be extended beyondthe age of superannuation.(Finance Memo. No.119194, F.R.60-3, dated 12th March 1960.)112. If a Government servant is transferred to foreign service while on leave, he ceases,from the date of such transfer, to be on leave and to draw leave-salary.RULINGS.Acceptance of employment under private employers.(1) The sanction of the Government of India will be required only in the case of officers of All-IndiaService desiring to accept private employment and no reference need be made to them in the case ofofficers appointed by the State Government or any lower authority.(G.O.
