CHAPTER VII—DEPUTATION OUT <strong>OF</strong> INDIA.50. No deputation of a Government servant out of India shall be sanctioned without theprevious approval of the Central Government.51. (1) When a Government servant is, with proper sanction, temporarily deputed for dutyout of India either in connection with the post held by him in India or in connection with anyspecial duty on which he may temporarily be placed, he may be allowed to draw during theperiod of deputation the same pay which he would have drawn had he remained on duty inIndia:Provided that a Government servant, who is placed on deputation while already on leaveout of India on average pay, may be required to continue to be on leave, in which case he shallbe given during that period, in addition to his leave salary, an honorarium of one-sixth of thepay which he would have drawn had he remained on duty in India; the cost of passages fromand to India shall be borne by him.Note.—The portion of the pay which a Government servant may be permitted to draw in foreigncurrency while on deputation abroad will be determined in accordance with the orders issued by the CentralGovernment in this regard from time to time.(2) A Government servant on deputation may also be granted a compensatory allowancein a foreign country of such amount as the Central Government may think fit.(3) The foreign exchange equivalent of the pay, honorarium or compensatory allowanceadmissible under sub-rule (1) or sub-rule (2) shall be calculated at such rate of exchange asthe Central Government may, by order prescribe.Note 1 to Rules 50 and 51.—Government may depute a subordinate police officer to any countryoutside India to accompany or take charge of criminals or lunatics or on any other business which formspart of his duty as a police officer and may grant to the officer so deputed (a) full pay for the entire period ofabsence from India, with (b) actual travelling expenses and a subsistence allowance not exceeding thefollowing scale while in any country outside India.TABLE£ s. d.To an officer of the Inspector Class 1 2 6 a dayDo. Constable ClassDelegation.The powers of Government under this note may be exercised by the Inspector-General of Police,Deputy Inspector-General of Police and the Commissioner of Police, Madras, subject to the conditionthat the allowances of the subordinate police officers deputed other than pay, are regulated by theTamil Nadu Travelling Allowance Rules.Notes 2-4.—Omitted.Note 5.—Rules regulating the grant of travelling and halting allowances of officers of the State andSubordinate Services and holders of special posts serving under Government when sent abroad ondeputation are given in Appendix II.Explanation.—The pay of the officers concerned who may be deputed to work out of India isgoverned by Fundamental Rule 51.Exception.—These rules do not apply to cases governed by special rules, e.g., study leave, foresttours., etc.RULINGS.(1) In the expression “pay which he would have drawn had he remained on duty in India” occurringin Rule 51 (1), the expression “pay” should be interpreted literally with reference to Rule 9(21) andshould be determined by the appropriate authority in India.92
