113. A Government servant transferred to foreign service shall remain in the cadre orcadres in which he was included in a substantive or officiating capacity immediately before histransfer and may be given subject to the conditions prescribed under the second proviso toFundamental Rule 22(i) (b) (ii) such substantive or officiating promotion in those cadres as theauthority competent to order promotion may decide. In giving promotion, such authority shallalso take into account—(a) the nature of the work performed in foreign service, and(b) the promotion given to juniors in the cadre in which the question of promotionarises.113-A. (a) If the service of a Government servant in a particular cadre is required by aforeign employer, and if no Government servant in that cadre is readily available, the seniormost person in the approved list for promotion to such cadre shall be promoted and deputedto the foreign service giving him the benefit of promotion with effect from the date of hisassuming charge in the foreign service.(b) When a Government servant is already on deputation and his name included in theapproved list for promotion and if his junior gets promotion in the regular line, the foreignemployer concerned shall be asked to examine whether they would like to upgrade the postheld by such Government servant and give him the benefit of promotion or revert him from theforeign service to Government Service and get the service of someone else from the lowercategory, if the foreign employer still wants to have the service of a Government servant fromsuch lower category. Upgrading of the posts held by the Government servants in the foreignservice shall be subject to the following conditions, namely:—(i) The Government servant in foreign service shall be one among those awaiting promotionon regular basis in the parent department.(ii) The post held by the Government servant in foreign service may be upgraded to thehigher post only when his junior is given promotion in the regular line in the parent department. Theupgrading of the post shall be done only once.(c) If the promotion of a Government servant in foreign service is to an intermediategrade lower than the next promotion post in the regular line in the parent department, it shallbe done with the concurrence of the parent department.[G.O. A Government servant in foreign service shall draw pay from the foreign employerfrom the date on which he relinquishes charge of his post in Government service. The amountof his pay, the amount of joining time admissible to him and his pay during such joining timeshall be fixed in consultation with the foreign employer.Delegations under Rule 114.1. All head of departments, the Joint Registrar of Co-operative Societies and the PersonalAssistant to the Registrar of Co-operative Societies have power to fix the pay in foreign service ofGovernment servants whose transfer to such service they are empowered to sanction, subject to thefollowing conditions:—(2) in rule 114, under the heading “Delegation under Rule 114”, in sub-rule (1), for clauses (a),(b) and (c), the following clauses shall be substituted, namely:—In F.R.114, under the heading “Delegations under Rule 114” in item 1,—In the Table under clause (a), in column (4) against the entry “(i) Pay” in column (1), the words “orconsolidated Pay” shall be omitted.[Vide G.O.
