RULE 84.ANNEXURE.Study Leave Rules1. Short title, commencement and application.—(1) These rules may be called the TamilNadu Study Leave Rules, 1965.(2) They shall come into force at once.(3) They shall apply to all Government servants under the rule-making control of theGovernment of Tamil Nadu.2. Definitions.—(1) In these rules, unless the context otherwise requires,—(a) “Audit Officer” means such officer as may be appointed by the Comptroller and Auditor-General of India.(b) “Head of Mission” means Ambassador, Charge-d-Affairs, Minister, Consul-General, Highcommissioner or any other authority declared as such by the Central Government in the country inwhich the Government servant studies or undergoes instruction.(2) All other words and expressions used in these rules but not defined shall have the meaningsrespectively assigned to them in the Fundamental Rules.3. Conditions for grant of study leave.—(1) Subject to the conditions specified in theserules, study leave may be granted to a Government servant with due regard to the exigenciesof public service to enable him to undergo, in or out of India, a special course of studyconsisting of higher studies or specialised training in a professional or a technical subjecthaving a direct and close connection with the sphere of his duty.(2) Study leave may also be granted—(i) for a course of training or study tour in which a Government servant may not attend aregular academic or semi-academic course if the course of training or the study tour is certified to beof definite advantage to Government from the point of view of public interest and is related to thesphere of duties of the Government servant;(ii) for the purposes of studies connected with the frame work or background of publicadministration, subject to the condition that the Government servant shall submit, on his return a fullreport on the work done by him while on study leave: and(iii) for the studies which may not be closely or directly connected with the work of aGovernment servant but which are capable of widening his mind in a manner likely to improve hisabilities as a civil servant and to equip him better to collaborate with those employed in otherbranches of the public service.Note.—Application for study leave in cases falling under clause (iii) shall be considered on meritsof each case.(3) Study leave shall not be granted unless—(i) it is certified by the Head of the department concerned that the proposed course of study ortraining shall be of definite advantage from the point of view of public interest;(ii) it is for prosecution of studies in subjects other than academic or literary subjects; and(iii) the Economic Affairs Department of the Ministry of Finance of the Government of Indiaagrees to the release of foreign exchange involved in the grant of study leave, if such leave is outsideIndia.(4) Study leave out of India shall not be granted for the prosecution of studies in subjects which foradequate facilities exist in India or under any of the schemes administered by the Economic AffairsDepartment of the Finance Ministry, the Ministry of Education and the Ministry of Scientific Researchand Cultural Affairs of the Government of India.295
