(1) Any information it receives from any source (including host country law enforcement) that alleges a<br />

<strong>Contract</strong>or employee, subcontractor, or subcontractor employee has engaged in conduct that violates this policy;<br />

and<br />

(2) Any actions taken against <strong>Contract</strong>or employees, subcontractors, or subcontractor employees pursuant to<br />

this policy.<br />

(f) Remedies. In addition to other remedies available to the Government, the <strong>Contract</strong>or's failure to comply<br />

with the requirements of paragraphs (c), (d), or (f) of this policy may result in –<br />

(1) Requiring the <strong>Contract</strong>or to remove a <strong>Contract</strong>or employee or employees from the performance of the<br />

contract;<br />

(2) Requiring the <strong>Contract</strong>or to terminate a subcontract;<br />

(3) Suspension of contract payments;<br />

(4) Loss of award fee, consistent with the award fee plan, for the performance period in which the Government<br />

determined <strong>Contract</strong>or non-compliance;<br />

(5) Termination of the contract for default or cause, in accordance with the termination clause of this contract;<br />

or<br />

(6) Suspension or debarment.<br />

(g) Subcontracts. The <strong>Contract</strong>or shall include the substance of this policy, including this paragraph (g), in<br />

all subcontracts.<br />

(h) Mitigating Factor. The <strong>Contract</strong>ing Officer may consider whether the Contactor had a Sexual Assault<br />

Prevention and Response training program at the time of the violation as a mitigating factor when<br />

determining remedies. Additional information about Sexual Assault Prevention and Response training<br />

H.76 <strong>Contract</strong>or Payments (Nov 2010). KSCR1-16.<br />

Currency: Payments made against this contract will be paid in local currency (Kuwait Dinar) if awarded to a non<br />

U.S. vendor. If contract award has been made to a U.S. contractor, payment will be made in U.S. currency (dollars).<br />

Payments shall be made via Electronic Funds Transfer (EFT), unless circumstances beyond a contractor’s control<br />

prevent this.<br />

H. 77 Sponsorship requirements (Aug 2010). KSCR1-17.<br />

Sponsorship: The <strong>Contract</strong>or shall obtain local sponsorship as required for all personnel for the purpose of<br />

providing in-country legal representation, work visas and resolution of other personal business or domestic matters,<br />

in compliance with host nation labor laws.<br />

Passports, Visa and Customs: The <strong>Contract</strong>or is responsible for identifying and obtaining all passports, visas, or<br />

other documents necessary to enter and/or exit any areas necessary for performance. All <strong>Contract</strong>or employees shall<br />

be subject to the customs, processing procedures, laws, and duties of Kuwait, and the procedures, laws, and duties of<br />

the United States upon re-entry. <strong>Contract</strong>ors are required to register all personnel with the appropriate U.S.<br />

Embassy or Consulate.<br />
