L.1 SPECIAL NOTICE – USE OF CONSULTANT CONTRACTORS<br />
The Government intends to use Federal Acquisition Strategies (FAS), Limited Liability Company (LLC), Davis<br />
Paige Management Systems (DPMS) LLC and/or other contractor support for administrative support during<br />
source selection and for the duration of the contracts; however, the exclusive responsibility for source selection<br />
resides with the Government. Proprietary information submitted in response to this solicitation will be protected<br />
from unauthorized disclosure as required by subsection 27 of the Office of Federal Procurement Policy Act as<br />
amended (41 United States Code (U.S.C.) 423) (hereinafter referred to as “the act”) as implemented in the FAR.<br />
FAS and DPMS are contractually bound by organizational conflict of interest (OCI) and disclosure clauses with<br />
respect to proprietary information. <strong>Contract</strong>or personnel are subject to the Procurement Integrity Act, 41 U.S.C.<br />
423 and will take all necessary action to preclude unauthorized use or disclosure of a competing contractor’s<br />
proprietary data. Nondisclosure and OCI certificates for all contractor support personnel are on file at the<br />
respective contracting activities.<br />
L.2 COMMUNICATIONS WITH THE GOVERNMENT<br />
The <strong>Contract</strong>ing Officer (KO) is the point of contact for this acquisition. Prospective offerors are cautioned against<br />
contacting other Government personnel in regard to this solicitation prior to contract award(s). Prospective offerors<br />
are also cautioned to advise potential subcontractors or teaming contractors of this instruction. If such contact occurs<br />
and is found to be prejudicial to competing offerors, the offeror (including subcontractors or teaming contractors)<br />
making such contact may be excluded from award consideration. Changes to the solicitation will be communicated<br />
via written amendment to the solicitation posted on the Federal Business Opportunities (FedBizOpps) website,<br />
https://www.fbo.gov/.<br />
L.2.1 All communications with the Government shall be directed to the KO, via email at<br />
globalintelligence@mi.army.mil.<br />
L.3 CLAUSES<br />
l.3.1.1 52.215-1 INSTRUCTIONS TO OFFERORS – COMPETITIVE ACQUISITION (JAN 2004)<br />
As prescribed in 15.209(a), insert the following provision:<br />
(a) Definitions. As used in this provision --<br />
“Discussions” are negotiations that occur after establishment of the competitive range that may, at the <strong>Contract</strong>ing<br />
Officer’s discretion, result in the offeror being allowed to revise its proposal.”<br />
“In writing,” “writing,” or “written” means any worded or numbered expression which can be read, reproduced, and<br />
later communicated, and includes electronically transmitted and stored information.<br />
“Proposal modification” is a change made to a proposal before the solicitation’s closing date and time, or made in<br />
response to an amendment, or made to correct a mistake at any time before award.<br />
“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed<br />
by a <strong>Contract</strong>ing Officer as the result of negotiations.<br />
“Time,” if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include<br />
Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then<br />
the period shall include the next working day.
