A. Yes, sir.<br />

Q. And you find a mistake now ^<br />

A. A great mistake.<br />

Q. How much <strong>of</strong> a mistake?<br />

A. About ninety-five feet.<br />

Q. Might not that error be in <strong>the</strong> angles as well as in <strong>the</strong> distances?<br />

A. It might be ; I am only saying how I found <strong>the</strong> gangway.<br />

Q. And you notified Mr. Womelsdorf <strong>of</strong> water lying in old No. 8?<br />

A. I did.<br />

Q. And you thought <strong>the</strong>re were from forty to fifty feet <strong>of</strong> solid rock<br />

between No. 11 breast <strong>and</strong> terminus <strong>of</strong> gangway <strong>of</strong> No. 8?<br />

A. Yes, sir.<br />

Q. Now, in your opinion, as a matter <strong>of</strong> fact, did No. 1 1 breast drive<br />

into old No. 8 gangway through that error ?<br />

A. No. 11 breast drove into No. 8 gangway through that error or it<br />

would not have driven in.<br />

Q. And in your judgment that was <strong>the</strong> cause <strong>of</strong> <strong>the</strong>se men's deaths?<br />

A. That was <strong>the</strong> cause <strong>of</strong> <strong>the</strong>ir deaths.<br />

Q. Who placed this pencil sketch on this map ?<br />

A. Mr. Womelsdorf placed it <strong>the</strong>re <strong>and</strong> showed it to me. Then he<br />

said we had driven our breast into breast No. 6 <strong>of</strong> No. 8 gangway.<br />

Q. We would like to know who died on account <strong>of</strong> this accident?<br />

A. Edward Gallagher, breast No. 12 on south side <strong>of</strong> gangway;<br />

Patrick Kelly, breast No. 11, south side <strong>of</strong> <strong>the</strong> gangway; James Ward,<br />

breast No. 9, north side <strong>of</strong> gangway ; Michael Polish, found in top <strong>of</strong><br />

breast No. 9 north side <strong>of</strong> gangway; Samuel Porter, in breast No. 9 in<br />

<strong>the</strong> western man way, north side <strong>of</strong> gangway ; Lawrence Eeed, Henry<br />

Ball, Michael Smith <strong>and</strong> James Balack, found in breast No. 1 south side<br />

<strong>of</strong> <strong>the</strong> sou<strong>the</strong>ast gangway; Joseph Orsock, breast No. 1 south side <strong>of</strong><br />

sou<strong>the</strong>ast gangway ; Bernard McCloskey, found at <strong>the</strong> junction <strong>of</strong> <strong>the</strong><br />

nor<strong>the</strong>ast <strong>and</strong> sou<strong>the</strong>ast gangways, in front <strong>of</strong> a mine car ; James Griffiths,<br />

found at <strong>the</strong> same place between cars <strong>and</strong> pillar; Thomas Geke, found<br />

in <strong>the</strong> nor<strong>the</strong>ast gangway floating on <strong>the</strong> water.<br />

Caleb Williams, a witness, being sworn, testified as follows:<br />

Q. What is your business ?<br />

A. I am inspector for <strong>the</strong> Lehigh Valley Coal Company.<br />

Q. What are your duties ?<br />

A. I see that <strong>the</strong> coal is taken out properly from <strong>the</strong> mines.<br />

Q. Have you inspected <strong>the</strong>se mines where this accident occurred?<br />

A. Yes, sir.<br />

Q. Do you use any map to govern you?<br />

A. Yes, I have a map. The Lehigh Valley Coal Company furnished it.<br />

Q. Who makes <strong>the</strong> map ?<br />
